APPLICANT REQUESTS THAT:

1.  His Officer Selection Brief (OSB)  and  duty  history  be  corrected  to
reflect "Chief of Tactics," as his duty title for the 1995-1997 timeframe.

2.  He be considered by Special Selection Board (SSB) for the Calendar  Year
2006C (CY06C) and  CY07B  Lieutenant  Colonel  (Lt  Col)  Central  Selection
Boards (CSB).

APPLICANT CONTENDS THAT:

From 1 September 1995 to 7 July 1997, he was the 40th Rescue  Flight  (RQF),
Chief of Tactics.  At the time, there  were  no  manpower  numbers  for  the
position  so  it  could  not  be  added  as  a  duty  title  on   his   OPR.
Consequently, it was never placed into his duty history.  Tactics  expertise
is a significant discriminator  when  being  considered  for  promotion  and
other opportunities.  Not  having  this  experience  listed  in  his  career
history has undoubtedly hurt his advancement opportunities.   He  has  tried
multiple times to get this updated through the  Virtual  Military  Personnel
Flight (VMPF) without success.

In support of his request, the applicant provided an AF Form  707B,  Company
Grade Officer Performance report; an AFCM citation, and  a  memorandum  from
his previous commander.

STATEMENT OF FACTS:

The applicant was commissioned in the Regular Air Force on  1 May  1993  and
was progressively promoted to the grade of major, having assumed that  grade
effective and with a date of rank (DOR) of 1 May 2003.

The applicant was considered but not selected by the CY06C  and  CY07B  CSBs
which convened on 28 November 2006 and 27 November 2007,  respectively.   He
was considered by an SSB for promotion to the grade of LTC by the CY06C  CSB
on a separate issue, and was not selected for promotion.

AIR FORCE EVALUATION:

AFPC/DPAOM6 recommends denial.  DPAOM6 states the award  citation  does  not
provide suitable documentation to update a member’s duty history.   AFI  36-
2401 Correcting Officer and Enlisted Evaluation  Reports  states  "Citations
are not specific enough to offset the comments and  ratings  in  a  report."
Based on this, the applicant has not  submitted  adequate  documentation  to
update his duty history

AFPC/DPPSO recommends denial.   DPPSO  states  the  Air  Force  Commendation
Medal (AFCM) citation awarded for the period 3 April 1995 to 5 October  1999
was filed in the applicants record and contains the statement "Appointed  as
Air Force Space Command’s  first-ever  Tactics  Officer,..."  As  such,  the
board members had this information available to them  during  the  promotion
selection process.  After a careful review  of  his  application  DPPSO  has
determined that a material error did not exist in his record and  trust  the
results of the original board were based on a complete  review  of  the  his
entire  selection  record,  assessing  whole  person  factors  such  as  job
performance,  professional  qualities,  depth  and  breadth  of  experience,
leadership, professional  military  education,  and  specific  achievements.
The selection Board had his entire selection record  that  clearly  outlined
his accomplishments since the day he came on active duty.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant responded stating the advisory refers to his selection  to  Lt
Col in two primary boards and one supplemental  Board.   He  asks  that  the
Board ignore this information  when  considering  his  request.   This  case
should be decided solely upon its own merits.  Previous  board  results  are
irrelevant since the basic injustice  still  exists.   The  failure  of  his
records  to  indicate  tactics  experience  will  continue  to  affect   all
subsequent personnel decisions in his career.  He has  tried  several  times
to correct his duty  history  but  was  unsuccessful.   Due  to  excessively
stringent administrative and personnel policies, he was not  able  to  place
Chief of Tactics in his duty  history  or  OPR  at  the  time.   All  pilots
appointed as tactics officers since then have received credit for  this  job
in their duty history, he is asking for  the  same.   To  be  penalized  for
being the first in a long line of tactics officers would surely  qualify  as
an injustice.  Since his September 1999 AFCM citation referred to "Chief  of
Tactics," the advisory states board members had this  information  available
to them when considering his record for promotion.  While that statement  is
technically correct, it is extremely deceptive and bears clafification.   To
insinuate, under these circumstances, that a one line  statement  buried  in
the back of his records was “readily available” for  consideration  is  just
not accurate.   The  simple  fact  is  that  promotion  boards  rely  almost
exclusively on the  Promotion  Recommendation  Form  (PRF)  and  (OSB)  when
rendering their decision.  Not having the role of tactics  officers  readily
apparent on his preselection  brief  and  surf  undoubtedly  put  him  at  a
disadvantage against peers who had comparable experience  listed.   Even  if
the Board should deny his request to meet a  supplemental  selection  Board;
he humbly asks them to comply with adding Chief of Tactics to  his  records.
He hopes to avoid  future  negative  repercussions  based  on  this  glaring
mistake in his official records.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence  of  an  error  or  injustice.   After  thoroughly  reviewing  the
evidence of record and  noting  the  applicant’s  contentions,  we  find  no
evidence which would lead us to believe that the contested duty title  entry
was erroneous; and, we are not persuaded by his assertions that its  absence
in his duty history has caused him to be the victim of  an  injustice.   The
duty information in question was reflected on his AFCM  citation  closing  5
October 1999, this citation was available  to  the  selection  boards  under
review, and we agree with the Air Force  office  of  primary  responsibility
that the  selection  boards  did  have  access  to  the  information.   More
importantly, we are not persuaded that the absence of  this  information  on
his OSB caused his record to be so erroneous or  misleading  that  the  duly
constituted selection board, vested  with  the  discretionary  authority  to
score records for promotion,  was  unable  to  make  a  reasonable  decision
concerning his promotability.   Therefore,  in  the  absence  of  persuasive
evidence to the contrary, we find no compelling basis to recommend  granting
the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did  not  demonstrate  the
existence of error or injustice;  the  application  was  denied  without  a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered  with  this
application.
