APPLICANT REQUESTS THAT:
His Officer Selection Brief (OSB) for the Calendar Year 2006C (CY06C)
Lieutenant Colonel Central Selection Board (CSB) be corrected to reflect
his correct assignment history and that he receive Special Selection Board
(SSB) consideration for promotion to the grade of lieutenant colonel by the
CY06C selection board.

APPLICANT CONTENDS THAT:
His Air Force Officer Pre-selection Brief (OPB) was inaccurate when the
CY06C Lieutenant Colonel Board convened. In the assignment history
section, three of his duty titles did not match his actual duty titles on
his Officer Performance Reports (OPRs). The generic duty title
“Intelligence Officer” did not accurately reflect the level of
responsibility commensurate with the actual duties he performed. He
believes these errors misled the board members and was an overall detractor
which possibly led to his nonselection to lieutenant colonel.
In support of his request, the applicant provided documents extracted from
his military personnel record.

STATEMENT OF FACTS:
Applicant is currently serving on extended active duty in the grade of
major with a date of rank of 13 May 2003.
The applicant was considered and not selected for promotion to the grade of
lieutenant colonel by the CY06C (28 November 2006) Lieutenant Colonel CSB.
The OSB prepared for the CY06C selection board reflected a duty title of
“Intelligence Officer” for the 10 February 2001, 16 June 2004, and 10 July
2005 entries in the Assignment History section.
AFPC/DPPPO has advised that the Assignment History of the OSB has been
updated to reflect the duty titles of Assistant Director of Operations,
effective 10 February 2001; Commander, ISR OPS Flight effective, 16 June
2004; and Chief, J2 Current Operations effective 10 July 2005.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial. DPPPO states central boards evaluate the
entire selection record to include the promotion recommendation form, OPRs,
officer effectiveness reports, training reports, letters of evaluation,
decorations, and data on the OSB. The board members assess whole person
factor such as job performance, professional qualities, depth and breadth
of experience, leadership and academic and professional military education
when rendering their decision. As such, DPPPO does not believe that the
contested assignment history errors on his OSB caused his nonselection for
promotion to lieutenant colonel. Furthermore, the OPR contains the correct
duty title and organization so the board members were able to take it into
consideration in the promotion selection process. The applicant failed to
exercise reasonable diligence in ensuring his record was accurate prior to
the CSB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 10 August 2007, the evaluation was forwarded to the applicant for review
and comment within 30 days (Exhibit D). As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. We took notice of the applicant’s
complete submission in judging the merits of the case; however, we are not
persuaded by the evidence presented that corrective action is warranted.
In support of his appeal the applicant provided a copy of his OPB which was
generated on 11 July 2006, reflecting the duty titles the applicant
contends are in error. We took note that the selection board in question
convened over three months after the OPB was generated. However, we found
no evidence showing he made reasonable effort to correct his record prior
to the convening of the board, as it was his responsibility to do so.
Furthermore, we agree with the Air Force office of primary responsibility
that the duty titles reflected on his OPRs provided the selection board
members adequate representation of his duties and responsibilities during
the rating periods. Evidence has not been provided by the applicant, which
would persuade us that the information contained on his OSB caused his
record to be so inaccurate and misleading that the board members, charged
with the discretionary authority to score his records, were unable to make
a reasonable judgment concerning his promotability in relation to his
peers. Therefore, in the absence of persuasive evidence to the contrary,
we find no compelling basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not demonstrate the
existence of an error or injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.
