APPLICANT REQUESTS THAT:
The Air Force Commendation Medal (AFCM) be added to his records.

APPLICANT CONTENDS THAT:
He should have been awarded the AFCM for his military service.
In support of the appeal, applicant submits a personal statement, NA Form
13059, National Archives and Records Administration, and excerpts from his
military personnel records.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 30 Jun 66, for a term of
four years, and was trained as an aircraft mechanic. He was released from
active duty on 30 Jan 70, under the provisions of AFR 39-10, Administrative
Separation of Airmen, for Release from Active Duty and received an
honorable discharge. He served a total of three years, seven months, and
one day active duty service.
The Report of Separation issued in conjunction with his 30 Jan 70,
honorable discharge, indicates that he was awarded the National Defense
Service Medal, the Small Arms Experts Marksmanship Ribbon, and the Air
Force Outstanding Unit Award.
The AFCM was authorized by the Secretary of the Air Force on 28 Mar 58, for
award to members of the Armed Forces of the United States who, while
serving in any capacity with the Air Force after 24 Mar 58, shall have
distinguished themselves by meritorious achievement or service.

AIR FORCE EVALUATION:
AFPC/DPSIDR recommends denial of the applicant’s request and states, in
part, the applicant was unable to locate or furnish any documentation to
substantiate his case for the AFCM. There is no documentation to verify
that he was awarded the AFCM. Additionally, the Southwest Asia Service
Medal is awarded to members of the United States Armed Forces who served in
support of Operation Desert Shield or Desert Storm, between 2 Aug 90 and 30
Nov 95. The NA Form 13059 is not an official Air Force document and the
SWASM was erroneously marked.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The statements he provided are factual and the action taken by the squadron
commander prevented him from receiving the AFCM.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. After a thorough review of the
applicant’s submission and the available evidence of record, we are not
persuaded the requested relief should be granted. In this regard, we note
that insufficient evidence has been presented to show that he was
recommended for, or awarded, the AFCM. Should the applicant secure such
evidence, the Board would reconsider his application. In the absence of
such evidence, we find no compelling basis to warrant favorable
consideration of the relief sought in this application.

The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
