APPLICANT REQUESTS THAT:
His DD Form 214, Armed Forces of the United States Report of
Transfer or Discharge be corrected to reflect:
1. Award of the Air Force Commendation Medal (AFCM).
2. Credit for service in Vietnam.

APPLICANT CONTENDS THAT:
Due to an administrative error, his service in Vietnam and the
AFCM were not reflected on his DD Form 214.
In support of his request, the applicant provides copies of his
DD Form 214 and citation for the AFCM.

STATEMENT OF FACTS:
On 16 Aug 67, the applicant contracted his enlistment in the
Regular Air Force. He was progressively promoted to the grade of
sergeant, having assumed the grade effective and with a date of
rank of 1 Jul 69. He was honorably discharged on 3 Jun 71. He
served three years, seven months and eight days of active
service.
On 11 May 10, AFPC/DPAPP informed the applicant that they
confirmed and verified his boots on ground foreign service in Cam
Ranh Bay AB, Vietnam, and that the foreign service on his DD Form
214 is correct.
On 7 Jun 10, AFPC/DPSIDRA informed the applicant that his
eligibility and entitlement to the Vietnam Service Medal with two
Bronze Service Stars, the Republic of Vietnam Gallantry Cross
with Palm, and the Republic of Vietnam Campaign was verified and
his records would be administratively corrected to reflect the
medals.

AIR FORCE EVALUATION:
HQ AFPC/DPSIDR recommends denial of the AFCM. AFPC/DPSIDR states
the AFCM is awarded to service members who, while serving in any
capacity with the Air Force after 24 Mar 58, shall have
distinguished themselves by meritorious achievement or service.
The degree of merit must be distinctive, but is not required to
involve the voluntary risk of life required for the Soldiers
Medal (or the Airmans Medal now authorized for the Air Force),
be considered for the AFCM.
According to AFPC/DPSIDR, there is no special order or
certificate provided by the applicant or located within his
official military records that would support he was recommended
for or awarded the AFCM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 25 Jun 10, for review and comment within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took note
of the documentation provided in support of the applicants
request for award of the AFCM; however, we agree with the opinion
and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our
decision that the applicant has failed to sustain his burden of
proof of the existence of an error or injustice. In regard to
his service credit in Vietnam, AFPC/DPAPP confirmed and verified
his foreign service and informed him that his DD Form 214
accurately reflects his foreign service. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.
