His records are inaccurate and do not reflect awards for his service.

STATEMENT OF FACTS:
Documents in the applicant’s military personnel record reflect the
applicant served various assignments in the Air Corps, Army, Air Force, and
Reserve components from 1944 to 1951.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial. DPPPR states applicant served in the
Mediterranean Theater Operation (MTO) from 1 March 1946 to 30 November
1946. Applicant was informed on 2 June 1997 and 28 August 1991 [sic] that
they could not verify he was recommended for or awarded the GCM. Applicant
was informed by DPPPR on 2 June 1997, that they were unable to verify his
entitlement to the European-African-Middle Eastern Campaign. The European
Theater requires service during the period of 7 December 1941 to 8 November
1945. Applicant did not meet the requirement due to the inclusive time
period he served in the MTO. His official records have been previously
researched by DPPPR several times and he was awarded additional
entitlements in 1997 for other operations he participated in. He was
previously awarded the Air Medal, World War II Victory Medal, Medal of
Humane Action, Army of Occupation Medal – German with Berlin Airlift
Device, Honorable Lapel Button and the Overseas Bar. DPPPR is unable to
verify any additional entitlements.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the evaluation and states his military records were
destroyed in the Philippines. He states his Form 5 record can prove he is
entitled to the contested awards.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. The applicant’s contentions are duly
noted; however, after thoroughly reviewing the applicant’s submission and
the evidence of record there is no indication in the applicant’s military
personnel record that he is entitled to the GCM. The applicant has not
provided any evidence which would lead us to believe otherwise. Therefore,
we agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt its rationale as the basis for our
conclusion that the applicant has not been the victim of an error or
injustice. In the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought.

The applicant be notified the evidence presented did not demonstrate the
existence of an error or injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.

In addition, they verified his entitlement to the Air Force Good Conduct Medal and the Armed Forces Expeditionary Medal with one Bronze Service Star, and indicated his separation document will be updated to reflect these awards (Exhibit E). He did not provide an order awarding him the AM, and they were unable to verify his entitlement to the award. After a thorough review of the evidence of record and applicant’s submission, we are unpersuaded he should be awarded the AM.
