RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2007-01435
INDEX CODE: 112.01
COUNSEL: NONE
HEARING DESIRED: NO
MANDATORY CASE COMPLETION DATE: Nov 11, 2008
_________________________________________________________________
APPLICANT REQUESTS THAT:
His home of record (HOR) be changed from Clovis, New Mexico to Stillwell,
Oklahoma.
_________________________________________________________________
APPLICANT CONTENDS THAT:
He was living in New Mexico for a short period of time to attend school.
He chose to enlist midway through the semester.
His immediate family lives in Oklahoma and that is where he will be
returning when he completes his military service.
He understands his HOR is where he enlisted; however, this is not his home
and he would like to correct this error.
He was looking into taking a concurrent overseas tour leave and discovered
his HOR was not Oklahoma. He now understands future HOR actions such as
retirement, separation, etc., will reflect New Mexico.
The applicant's complete submission is at Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant is currently serving in the active duty Air Force in the
grade E-5 (staff sergeant).
At the time of his initial enlistment of 27 Oct 99, his home of record was
listed as Portales, New Mexico.
On 23 Jan 04, the applicant reenlisted and used the same Portales, New
Mexico address.

AIR FORCE EVALUATION:
AFPC/DPPAE recommends denial of the applicant’s request. DPPAE requested
the applicant provide additional information on 15 May 07; however, the
applicant failed to provide the requested information. He must submit
documentation showing his current HOR listed was a bona fide error. Once
the applicant obtains and submits the documentation, he can resubmit his
case with evidence at a later date for proper evaluation of his claim.
The AFPC/DPPAE complete evaluation, with attachments, is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 10 Aug
07 for review and comment within 30 days. As of this date, this office has
not received a response.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.
_______________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
