APPLICANT REQUESTS THAT:
His Meritorious Service Medal (MSM) (1OLC) be included in the CY06C
Lieutenant Colonel Central Selection Board (CSB) Officer Selection Record
(OSR) that will be meeting a Special Selection Board (SSB).

APPLICANT CONTENDS THAT:
He has been approved for a SSB as a result of another issue; and he is now
asking that the MSM be included in the OSR prior to the SSB.
From 1-19 Sep 05, he was a detachment commander for a helicopter crew that
provided assistance to the victims of New Orleans and Mississippi, and that
the 46th Test Wing decided to award their accomplishments with the Airman’s
Medal (AM). The paperwork for the AM was submitted in early 2006 to HQ
AFMC and was disapproved on 21 Mar 07. The 46th Test Wing then resubmitted
a MSM to recognize their efforts. The applicant contends that had the AM
denial been more expeditiously processed the MSM would have been in his
record for the P0506C board.
In support of his request, applicant provided copies of his MSM citation,
the Airman Medal disapproval letter, and e-mails pertaining to his award.

STATEMENT OF FACTS:
The applicant is presently serving on active duty in the grade of major
with a date of rank of 1 Dec 02. His Total Active Federal Military Service
Date (TAFMSD) is 27 May 92. The applicant was considered but not selected
for promotion to the grade of lieutenant colonel by the P0506A Lieutenant
Colonel CSB. He is scheduled to meet a SSB as a result of a missing
officer performance report.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends denial of the applicant’s request to include the MSM
in his OSR for the SSB. The absence of the MSM (1OLC) from his P0506C OSR
is not an error - the decoration was processed within AFI 36-2803’s
guidelines.
In reviewing his OSR and the attached special order, they determined that
the applicant’s MSM (1OLC), awarded by Special Order (SO) G-182, dated 10
May 07, was processed within the guidelines of AFI 36-2801, paragraph 3.1.
These guidelines state that decoration recommendations are entered “into
official channels within 2 years and awarded within 3 years of the act,
achievement, or service performed.” Furthermore, in accordance with
published guidance, the decoration award authority announces its final
decision when approving an award by publishing special orders. These
orders serve as the source document for updating the decoration in the
Military Personnel Data System. Since the order for this decoration was
published on 10 May 07, the citation could not have been filed in his
selection record nor reflected in any of their official personnel data
systems when the board convened.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 3 Aug 07, a copy of the Air Force evaluation was forwarded to the
applicant for review and comment within 30 days. To date, a response has
not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We took notice of the applicant's
complete submission in judging the merits of the case; however, we agree
with the opinion and recommendation of the Air Force office of primary
responsibility and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of an error or injustice. Therefore,
in the absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

However, noting the Air Force's assessment that the correct duty title was reflected on his OPR covering the contested period and therefore, available to the selection board members, and finding no persuasive evidence that this discrepancy in and of itself, caused his nonselection for promotion, we agree with the Air Force that SSB consideration was not warranted.
