APPLICANT REQUESTS THAT:
He be awarded the Air Medal (AM), Air Force Good Conduct Medal, Small Arms
Expert Marksmanship Ribbon, Bronze Star Medal, and the Air Force
Commendation Medal.

APPLICANT CONTENDS THAT:
His DD Form 214 does not reflect the requested decorations, medals,
citations and campaign ribbons. He filed a claim for service-connected
disability; however, he could not prove he was in Vietnam.
In support of his request, the applicant provided documents extracted from
his military personnel record.

STATEMENT OF FACTS:
Applicant retired from the Air Force in the grade of master sergeant after
21 years and 6 months of active service.
His military records have been corrected to reflect the requested medals,
with the exception of the AM. Therefore, his request for award of the AM
is the only item requiring consideration by the Board. He has been issued
a corrected DD Form 214 to reflect the corrections.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial. DPPPR states to be awarded the AM, a member
must provide documentation to support acts of heroism or meritorious
achievements while participating in aerial flight, in actual combat, in
support of operations.
On 1 June 2007, DPPPR sent the applicant a letter requesting additional
documentation to support his claim for award of the AM. He has not
responded to the request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 27 July 2007, the evaluation was forwarded to the applicant and counsel
for review and comment within 30 days (Exhibit D). As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest
of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. The applicant’s contentions are duly
noted; however, after reviewing the evidence of record along with the
applicant’s submission, the Board agrees with the opinion and
recommendation of the Air Force office of primary responsibility and adopts
its rationale as the basis for their conclusion that the applicant has not
been the victim of an error or injustice. The Board found no evidence in
the documentation provided which would substantiate acts or achievements
meeting the criteria for award of the AM. In the absence of such evidence,
the Board finds no basis to favorably consider his request.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not demonstrate the
existence of an error or injustice; the application was denied without a
personal appearance; and the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered with this
application.
