APPLICANT REQUESTS THAT:
His Officer Performance Report (OPR) rendered for the period 7 January 2006
through 6 January 2007 be removed from his records and replaced with the
corrected OPR.

APPLICANT CONTENDS THAT:
An incorrect draft of the OPR went final and was submitted in his permanent
record. The OPR that was submitted was an older draft. Due to an
administrative oversight, the incorrect version was erroneously submitted
and signed by the appropriate parties.
In support of his request, the applicant provides a copy of the original
OPR and the corrected OPR. The applicant’s complete submission, with
attachments, is at Exhibit A.

STATEMENT OF FACTS:
The Military Personnel Database (MilPDS) indicates the applicant has a
Total Active Federal Military Service Date and a Total Active Federal
Commissioned Service Date of 28 May 1997. He was promoted to the grade of
major, effective and with a date of rank of 1 January 2007.

AIR FORCE EVALUATION:
AFPC/DPPPEP recommends denial. DPPPEP advises there is no substantial
evidence to validate the applicant’s claim. The applicant must provide a
reaccomplished report that meets the requirements as outlined in AFI 36-
2401, Correcting Officer and Enlisted Evaluation Reports, and supporting
documentation/information from credible officials (evaluators). The
AFPC/DPPPEP complete evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was sent to the applicant on 27
April 2007 for review and comment. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. Applicant contends that an incorrect
version of the Officer Performance Report (OPR) was erroneously submitted
in his permanent record. We note it is Air Force policy that an evaluation
report is accurate as written when it becomes a matter of record. To
effectively challenge an OPR, it is necessary to hear from all the members
of the rating chain, not only for support, but also for
clarification/explanation. Other than his own assertions, the applicant
has failed to provide evidence that the OPR in question was not rendered in
good faith by his evaluators and has also failed to provide support from
the rating chain on the contested OPR. Therefore, we are in agreement with
the Air Force office of primary responsibility assessment and adopt its
rationale as the basis for our conclusion that the applicant has not been
the victim of an error or injustice. In the absence of evidence to the
contrary, we find no basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

Each time the report was corrected the current date was used to re-sign the report rather than the date the report was originally signed. Accordingly, the Board recommended the applicant be reinstated to active duty, provided a constructive reenlistment with entitlement to an SRB, and provided supplemental consideration for promotion to the grade of staff.
