APPLICANT REQUESTS THAT:
Her records be corrected to show she declined coverage for the Family
Servicemember’s Group Life Insurance (FSGLI) and she be reimbursed $330.00
for premiums she paid.

APPLICANT CONTENDS THAT:
The Defense Finance and Accounting Service failed to provide clear and
accurate information on the FSGLI procedures regarding military personnel
married to other military members.

STATEMENT OF FACTS
The applicant enlisted in the Regular Air Force on 11 January 1983, was
progressively promoted to the grade of master sergeant and retired in that
grade on 1 August 2004. A stipend overpayment in the amount of $330 was
deducted from her pay in three increments of $100.00, one for $20.00 and
another for $10.00.
On 8 March 2006, the applicant's request for reimbursement of $330.00 FSGLI
premiums was considered and denied by the Board. For an accounting of the
facts and circumstances surrounding the applicant’s request, and, the
rationale of the earlier decision by the Board, see the Record of
Proceedings at Exhibit I.
On 17 April 2006, the applicant submitted a request for reconsideration.
To support her request, she provided a personal statement and page six of
the DOD Financial Management Regulations Volume 7A, Chapter 47H, part of an
in-processing briefing from Fort Huachuca, a page for the January 2006,
HQDA Army Family Action Plan Conference and an article from the Navy Legal
Service Office Southwest. The applicant's complete submission, with

THE BOARD CONCLUDES THAT:
Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. After again reviewing this application
and the evidence provided in support of her appeal, we remain unpersuaded
that the applicant should be reimbursed for premiums paid in the amount of
$330.00. We carefully considered the statements provided by the applicant
as well as the evidence of the record and find no error or injustice. The
Board notes partial remarks from the applicant’s 1 November 2001, Leave and
Earnings Statement, show that she was notified to reduce or decline
spouse’s coverage by 31 December 2001 to receive a refund of any premiums
paid and there is no indication she took action at that time. As
previously noted the Air Force put together an aggressive campaign to make
members aware of the FSGLI program and their benefits and fully complied
with the law by providing information in advance of implementation so that
members could make an informed decision. We believe the applicant was
provided ample time to decline coverage upon the start of the FSGLI
advertisement campaign. Accordingly, the applicant’s request is not
favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the additional evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
