APPLICANT REQUESTS THAT:
She be reimbursed for the full amount of Family Servicemember’s Group Life
Insurance (FSGLI).

APPLICANT CONTENDS THAT:
In September 2005, FSGLI premiums began being deducted from her pay. She
was never told she had to decline the FSGLI or knew there were two types of
insurance. She went to the records section to decline her SGLI and was
advised she was only being charged SGLI premiums. When she reviewed her
May 2006 Leave and Earnings Statement (LES), she noticed her pay was being
deducted by $50 since October 2005. As of 18 May 2006, she declined the
FSGLI; however, she feels the debt is an injustice.
In support of her request, the applicant provided copies of her LES's for
the periods August 2005 through October 2005 and April 2006.

STATEMENT OF FACTS:
The applicant is a member of the Regular Air Force who is currently serving
in the grade of technical sergeant (E-6).

AIR FORCE EVALUATION:
AFPC/DPFC recommends a partial grant. DPFC states that it appears the
applicant attempted in good faith to decline the FSGLI coverage in August
2005, therefore, reimbursement of premiums from September 2005 until May
2006 is recommended. However, DPFC does not recommend relief of back
premiums for the period November 2001 through August 2005. The DPFC
complete evaluation, with attachments, is attached at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 14
July 2006 for review and response within 30 days. As of this date, this
office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an injustice warranting partial relief for reimbursement of
Family Servicemember's Group Life Insurance (FSGLI) payments from September
2005 to May 2006. In this respect, we note the applicant attempted to
decline the FSGLI coverage in August 2005, therefore, a relief from back
premiums for this period is warranted. However, we do not believe relief
of back premiums from November 2001 through August 2005 is appropriate.
Applicant's contentions were noted; however, we believe Air Force
authorities made every reasonable effort to inform the applicant of the
requirements set forth in Public Law 107-14 and agree with the opinion and
recommendation of the Air Force office of primary responsibility that total
reimbursement of her FSGLI premiums back to November 2001 is not
appropriate. Accordingly, we recommend the records be corrected to the
extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that on 1 September 2005, she executed
an SGLV Form 8286A, Family Servicemembers’ Group Life Insurance (FSGLI)
Election Certificate, declining any and all coverage, effective 1 September
2005.

DPFC explains the law mandated that coverage for spouses (to include military-married-to- military couples (mil-to-mil)) and dependent children automatically go into effect on the date of implementation so long as the member was insured under the SGLI program.
