APPLICANT REQUESTS THAT:
Her promotion to the grade of captain by the Army Reserve (USAR) be
transferred to the Air Force.

APPLICANT CONTENDS THAT:
She was on a USAR promotion list to captain prior to entering active
duty with the Air Force. The applicant’s complete submission, with an
Army 22 Aug 06 Notification of Promotion Status letter, is at Exhibit
A.

STATEMENT OF FACTS:
On 22 May 06, the Fiscal Year 06 (FY06) Captain, Reserve Component,
Army Medical Department (AMEDD) Selection Board convened.
The applicant transferred from the USAR and entered active duty with
the Air Force on 24 Jul 06 in the grade of first lieutenant (1LT) with
a date of rank (DOR) of 9 Dec 02.
The results of the FY06 Captain AMEDD board were approved on 7 Aug 06.
By letter dated 22 Aug 06, the US Army Human Resources Command
notified the applicant she had been selected for promotion to captain
with a promotion eligibility date (A-Date) of 8 Dec 07. The letter
advised that if her A-Date was earlier than the approval date of the
board, the earliest DOR she would have was the approval date of the
board.
According to HQ AFPC/DPPPO (Exhibit B), based on her extended active
duty (EAD) date and DOR, the applicant met the Air Force Calendar Year
2006C (CY06C) Captain Promotion Process, which closed on 30 Sep 06.
Pursuant to an inquiry from the AFBCMR Staff, HQ AFPC/DPPPOO advised
via email dated 31 Oct 06 that approval of the CY06C Captain process
by the Principal Deputy Under Secretary of Defense (Personnel &
Manpower) (PDUSD P&R) was not anticipated until around the end of
Nov 06. Had the Army Reserve promotion been approved at the time of
her transfer, the Air Force would have promoted the applicant on
25 Jul 06. Regardless of what the applicant would have had in the
Army Reserve, she will pin-on based on the Air Force timelines of her
two-year anniversary or the PDUSD P&R approval, whichever is later.
As long as she has a DOR in 2006, she will meet a major board in CY13.

AIR FORCE EVALUATION:
HQ AFPC/DPPPO recommends denial because the applicant was not on an
approved promotion list prior to entering active duty. Per AFI 36-
2501, Officer Promotions and Selective Continuation, 16 Jul 04,
promote in-the-promotion-zone (IPZ) 1LTs on the Active Duty List (ADL)
selected for promotion to captain after completing 24 months time-in-
grade (TIG) computed from their current grade DOR (CGDOR) as a 1LT, or
upon the PDUSD approval of the captain selection board report,
whichever is later. If the applicant is authorized to bring her
promotion from the USAR, she would be promoted on 25 Jul 06, the day
after entry onto active duty as she is already past her two-year
anniversary, provided she is recommended for promotion by her
commander.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the
applicant on 6 Oct 06 for review and comment within 30 days (Exhibit
D). As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After careful consideration of
the applicant’s submission and the available evidence of record, we
conclude her USAR selection for promotion to the grade of captain
should not be transferred to the Air Force. The FY06 Captain, Reserve
Component, AMEDD Selection Board convened on 22 May 06, but the
results were not approved until 7 Aug 06. In the meantime, on 24 Jul
06, the applicant had transferred to the Air Force and entered active
duty. The applicant has met the CY06C Captain Promotion Process and,
if approved, will pin-on based on the Air Force timelines of her two-
year anniversary or the PDUSD P&R approval, whichever is later. As she
clearly was not on an approved promotion list prior to entering active
duty, we agree with the Air Force that the applicant has not been the
victim of an error or an injustice. In view of the above and absent
persuasive evidence to the contrary, we find no compelling basis to
recommend granting this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
