APPLICANT REQUESTS THAT:
1. His extended active duty (EAD) orders be corrected to show his EAD date
as 10 June 2006 rather than 17 June 2006.
2. His wife’s travel across the country from his home of record (HOR) be
covered by the Air Force as a necessary and reimbursable expense.

APPLICANT CONTENDS THAT:
He was not properly informed that he could not travel to his base prior to
his EAD date.
In support of his request, the applicant provided a personal statement and
documents extracted from his military personnel records.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the grade of
second lieutenant.
An AF IMT Form 766, Extended Active Duty Order, reflects the effective date
of duty as 17 June 2006, with two days travel time. The order states “DO
NOT ARRIVE PRIOR TO YOUR EFFECTIVE DATE OF DUTY.”

AIR FORCE EVALUATION:
AFPC/DPPAO states considering the fact that the applicant did receive
conflicting information from the Executive Officer of the 9th, Operations
Group about his reporting to Beale AFB prior to his EAD date; and,
considering the fact that the Military Personnel Flight (MPF) allowed the
applicant to sign in prior to his return no later than date (RNLTD), they
recommend that his EAD orders be amended to reflect 14 June 2006 as his
date of duty. DPPAO further states that the applicant has not provided
proof that he was authorized to travel early. All indications are that he
was thoroughly briefed not to travel before his date of duty. The
applicant provided the information to his detachment personnel for
preparation of his EAD orders listing his address as Los Angeles, CA, which
only authorized two days travel time to Beale AFB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
The applicant reviewed the evaluation and states that in an email from AFPC
dated 21 March 2006, it was stated that his EAD date was 10 June 2006. He
was not given the option of traveling to Beale AFB from his home of record
in Virginia. Instead, he was told that he had to depart from Los Angeles,
limiting his authorized travel time to two days. Under the impression that
he had two days to travel and would be coming from his HOR with his new
bride, he asked that his EAD date be moved to 17 June 2006. This date was
confirmed and changed. It was stated that he received a Memorandum of
Instruction clearly stating not to travel prior to his EAD date or risk
forfeiture of travel pay. He does not remember receiving that memorandum.
The regulations behind EAD dates were not adequately communicated. He was
not fully informed on all options regarding EAD dates and departure
locations. The lack of clarity he encountered led him to believe that he
was acting in accordance with regulation and doing the right thing, at the
right time, and with right intentions.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice warranting partial relief. Applicant
requests his EAD date be changed to 10 June 2006 rather than 17 June 2006
and that his wife’s travel be a reimbursable expense. The applicant’s
contentions regarding these matters are duly noted; however, noting that
the applicant was provided orders which clearly state “DO NOT ARRIVE PRIOR
TO YOUR EFFECTIVE DATE OF DUTY” as well as having been verbally cautioned
regarding early departure, we are not persuaded that granting his request
in its entirety is warranted. Nevertheless, in view of the fact that he
received conflicting information and was allowed to sign-in upon his early
arrival, we agree with the recommendation of the Air Force that partial
relief is appropriate. Accordingly, we recommend his records be corrected
as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT, be corrected to show that he entered extended active duty on
14 June 2006, rather than 17 June 2006.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to XXXX, be corrected to show that he entered extended active duty
on 14 June 2006, rather than 17 June 2006.
