APPLICANT REQUESTS THAT:
His extended active duty date (EAD) be changed from 26 May 01 to 24 May
01.

APPLICANT CONTENDS THAT:
He was under the impression that he would be paid beginning the day he
showed for duty. The language on his orders was confusing and he
received no clarification on arriving early.
Getting married and essentially not having a place to live for the
summer required him to look at moving to Mountain Home early. He
planned to live in base housing and could not be placed on the waiting
list until he arrived on base.
The Traffic Management Office at Hill and Mountain Home Air Force Bases
allowed early travel. Finance paid him for early travel and the MPF
welcomed and inprocessed him early. He was also told by his sponsor
that he begin getting paid as soon as he arrived in the area.
He has the support of his Air Force Reserve Officer Training Corp
(AFROTC) commander and squadron commander to change his EAD.

STATEMENT OF FACTS:
The applicant was commissioned through the AFROTC program and presently
has a Total Active Federal Military Service Date (TAFMSD) of 26 May
2001.
The remaining relevant facts of this case are contained in the
evaluation done by the appropriate office of the Air Force at Exhibit
C.

AIR FORCE EVALUATION:
AFPC/DPPAO recommends denial of the applicant’s request. The
applicant’s EAD orders clearly stated in block 13 that the effective
date of duty was 26 May 2001 and that he should proceed and report on
or after this date. In addition, the applicant was provided a copy of
a memorandum that provided further explanation of his EAD order.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 25
Jan 02 for review and comment within 30 days. To date, a response has
not been received.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. We took notice of the
applicant's complete submission in judging the merits of the case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt their rationale as the basis
for our conclusion that the applicant has not been the victim of an
error or injustice. Therefore, in the absence of evidence to the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice; that
the application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
