APPLICANT REQUESTS THAT:
His effective date of duty be changed from 3 February 2002 to 15
January 2002.

APPLICANT CONTENDS THAT:
He was asked to come to the Space and Missile Systems Center for
possible job placement on 15 January 2002. He was advised to consult
the employment office for possible early activation. The NCOIC in the
employment office assured him that he could begin active duty that
day. Based on this information he quit his civilian job and reported
for duty on 15 January 2002.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the
applicant's military records, are contained in the letter prepared by
the appropriate office of the Air Force.

AIR FORCE EVALUATION:
AFMPC/DPPAO states block 13 on the applicant's Extended Active Duty
Orders (AF Form 766) has his effective date of duty as on or after 3
February 2002 and that he should report to Los Angeles AFB, no later
than 2400 hours on that date. Based on the information provided,
DPPAO recommends denying the applicant's request.
A complete copy of the Air Force evaluation is attached at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 5
April 2002, for review and response. As of this date, no response has
been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the evidence of
record, it appears that the applicant's appointment in the Air Force
Reserve was on 12 January 2002 and he was notified to report for in-
processing on 15 January 2002. While applicant's extended active
duty orders reflect he was to report on 3 February 2002, we note the
orders in question were issued on 31 July 2001. In view of the
evidence of record, we believe that the applicant's request should be
approved. Therefore, we recommend his records be corrected to the
extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show he entered active duty on 15
January 2002, rather than 3 February 2002.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the
Air Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, SSN, be corrected to show that he entered
extended active duty on 15 January 2002, rather than 3 February 2002.

HQ USAF/JAG states the applicant served exactly four years on active duty as an enlisted member. As of this date, no response has been received by this office (Exhibit E). The applicant did not meet the requirement of having served on active duty as an enlisted member for over 4 years to be eligible to receive O-1E pay.

Upon entry to active duty the DIEUS date was established as 13 May 1986 in accordance with AFI 36-2604, Service Dates and Dates of Rank, 1 July 1999, Table 1, Rule 13 and the applicant’s DD Form 4, 13 May 1986. The term "date entered service" means the date the person is enlisted, inducted or appointed...not TAFMSD. By signing a contract prior to 1 August 1986, the member’s retirement pay plan was, is and always will be “High-3”…the MRRA didn’t affect the member.
