APPLICANT REQUESTS THAT:
He receive Special Selection Board (SSB) consideration by the CY06A
Lieutenant Colonel Central Selection Board.

APPLICANT CONTENDS THAT:
On 21 February 2006, he express mailed a letter to the CY0605A Lieutenant
Colonel Central Selection Board President and received confirmation
delivery stating the package was received on 27 February 2006. A review of
his "As Met" record did not reflect his letter to the Board President.
In support of his request, applicant provides a copy of the United States
Postal Service delivery record and a copy of the letter to the Board
President with attachments.

STATEMENT OF FACTS:
Information extracted from the Military Personnel Data System (MilPDS)
indicates the applicant is currently serving on active duty in the grade of
major, with a date of rank of 1 May 2001. As of 5 September 2006, the
MilPDS reflects two nonselections to the grade of lieutenant colonel. The
applicant currently has an established date of separation (DOS) of 31 July
2007.
The applicant’s Officer Selection Brief (OSB) contains AF Forms 707A, Field
Grade Officer Performance Reports (OPRs) beginning with the rating period
2 June 1999 and ending on 13 December 2005 with overall ratings of “Meets
Standards.” On 28 June 2002, the applicant received an AF Form 475,
Education/Training Records, documenting his completion of Joint and
Combined Staff Officer School. In addition, the applicant’s OSB contains
three Air Force Commendation Medals for the periods 30 November 1990 to
11 December 1992, 21 March 1995 to 1 March 1997 and 23 January 1997 to 31
July 1999; the Meritorious Service Medal for the period 29 September 2002
to 30 July 2004; the Defense Meritorious Service Medal for the period 2
August 1999 to 1 August 2002 and the Joint Service Achievement Medal for
the period 8 March 2003 to 30 June 2003.

AIR FORCE EVALUATION:
AFPC/PB recommends denial. PB advises they are confident the applicant's
letter was in his Officer Selection Record at the time of the board. The
applicant was identified as a letter writer in the board-specific index
prior to the board. PB advises the clerk preparing the applicant's "As
Met" copy focused on the information reflected in ARMS at that time and
assumed all of the letters from the 13 March 2006 board were in the
database, when in fact they were not. The ARMS printout confirms the
letter was committed to the database on 13 July 2006 one week after the "As
Met" copy was produced. The AFPC/PB complete evaluation, with attachments,
is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was sent to the applicant on 11 August
2006 for review and comment within 30 days. As of this date, this office
has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We have reviewed the available evidence
pertaining to the applicant’s assertions that his Officer Selection Record
(OSR) did not contain his letter to the Board President. The applicant was
provided an "As Met" copy of his OSR, which was missing his letter to the
Board President. However, it appears that this was only due to a clerical
error during the reproduction of his OSR. The Air Force maintains, and we
are not persuaded otherwise by his assertions, that his letter was in his
OSR at the time of the selection board. Accordingly, we believe the
selection board had at its disposal a sufficiently accurate record on which
to base its decision concerning the applicant’s promotability. In view of
the above, we find no basis to recommend granting the relief sought in this
application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

The DPPPR evaluation is at Exhibit B. ARPC/DPPPO recommends the Board deny the applicant’s request for SSB consideration. It is the officer’s responsibility to ensure the accuracy of his record prior to the board convening date, not after he has been nonselected for promotion. After reviewing the evidence of record, we note the applicant’s OSR did not contain a copy of his DMSM citation, nor did his OSB reflect his award of his AAM/8OLC at the time the board convened.

His two Air Medals (AM) were absent from his OSR. This action took five months to complete; not timely processing. However, noting the Air Force's assessment that the correct duty title was reflected on his OPR covering the contested period and therefore, available to the selection board members, and finding no persuasive evidence that this discrepancy in and of itself, caused his nonselection for promotion, we agree with the Air Force that SSB consideration was not warranted.
