APPLICANT REQUESTS THAT:
His records be corrected to show he was awarded the Aerial Achievement
Medal (AAM) w/2OLC, the Meritorious Service Medal (MSM) w/4OLC, the Korean
Defense Service Medal (KDSM), the Iraq Campaign Medal (ICM), the
Afghanistan Campaign Medal (ACM), and the Global War on Terrorism
Expeditionary Medal (GWOT-E).
Examiner’s Note: DPPPR was able to verify the applicant’s entitlement to
the Aerial Achievement Medal w/2 OLC, the Meritorious Service Medal w/4
OLC, the Korean Defense Service Medal, and the Global War on Terrorism
Expeditionary Medal, and a DD 215 has been issued with these changes.
Therefore, only the ICM and ACM medals need to be addressed.

APPLICANT CONTENDS THAT:
The ICM and ACM medals were not updated in his personnel records because
DoD did not have the final criteria established. The awards were approved
after his records and DD Form 214 were closed out by his Military Personnel
Flight. He spoke with the Awards and Decoration personnel and they gave
him guidance [sic] that he was authorized all three awards. As an aircrew
member on C-5 aircraft, he flew missions in direct support of all three
campaigns. He was deployed to Manas Air base, Kyrgyz Republic from 20 Feb
04 to 5 May 04 and flew combat missions within Iraq and Afghanistan.
In support of his application, the applicant submits his personal statement
and copies of the following: citations, special orders, enlisted
performance reports, and travel vouchers.

STATEMENT OF FACTS:
On 31 Aug 04, the applicant was honorably relieved from active duty and
retired in the grade of CMSgt. He was credited with 32 years and 21 days
of total active duty service to include 8 years, 10 months and 18 days of
Foreign Service.

AIR FORCE EVALUATION:
HQ AFPC/DPPPR recommends disapproval of the applicant’s request for the ACM
and ICM. DPPPR states the ACM may be awarded to members of the Uniformed
Services of the United States who serve or who have served in Afghanistan
(or its contiguous air space) in support of Operation ENDURING FREEDOM from
24 October 2001 to a date to be determined. To be eligible for the ACM, a
service member must be assigned or attached to a unit participating in
Operating EUDURING FREEDOM for 30 consecutive days or 60 nonconsecutive
days in Afghanistan.
DPPPR states the ICM is awarded to recognize service members who served or
have served in the country of Iraq and the contiguous water area out to 12
nautical miles, and all air spaces above the land area of Iraq above the
contiguous water area out to 12 nautical miles of Iraq. Service members
must have been assigned, attached, or mobilized to units operating in the
area of eligibility for 30 consecutive days or 60 nonconsecutive days.
Service members qualified for the GWOT-E by reasons of service between 19
March 2003 and 28 February 2005, in an area for which the ICM was
subsequently authorized shall remain qualified for that medal. Upon
application, any such service members may not be entitled to both medals
for the same deployment, action, achievement, or period of service. DPPPR
was unable to locate source documentation to determine the quantity of days
in the area of eligibility to substantiate the requirements for the ACM or
the ICM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
In his response dated 2 October 2006, the applicant reiterates his earlier
contentions and submits a trip report that was not submitted with his
initial application (Exhibit E).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. After a thorough review of the available
records, we found no evidence that the applicant is eligible for the award
of the ICM or ACM medals. Additionally, the documentation provided by the
applicant does not meet the award criteria as specified by the Air Force
office of primary responsibility. Therefore, we agree with HQ AFPC/DPPPR
that the applicant does not meet the requirements for the ICM or ACM
awards. The personal sacrifice the applicant endured for his country is
noted and the recommendation to deny the requested relief in no way
diminishes the high regard we have for his service. Nevertheless, in view
of the above, we find no basis to favorably consider this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
