APPLICANT REQUESTS THAT:
His DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to show his entitlement to the:
1. Iraqi Campaign Medal with one Bronze Service Star (ICM, 1 BSS).
2. Afghanistan Campaign Medal with one Bronze Service Star (ACM, 1 BSS).

APPLICANT CONTENDS THAT:
He served two tours at Al Udeid Air Base, Qatar, and flew 70 combat sorties and 12 combat support group sorties into Iraq and Afghanistan in support of Operation IRAQI FREEDOM (OIF) Operation ENDURING FREEDOM (OEF). His tours of duty were from 3 Mar 04 to 10 May 04 and from 22 Sep 04 to 14 Dec 04.
In support of his request, the applicant provides a personal statement and copies of his Special Orders and travel vouchers.

STATEMENT OF FACTS:
The available records reflect the applicant retired in the grade of lieutenant colonel on 1 Sep 09.
The ACM may be awarded to members who serve or have served in Afghanistan (or its contiguous air space) in support of OEF from 24 Oct 01 to a date to be determined. Members must serve in the area of eligibility for at least 30 consecutive or 60 non-consecutive days, while participating as a regularly assigned crew member flying sorties into, out of, within, or over Afghanistan in direct support of OEF; each day that one or more sorties are flown in accordance with these criteria shall count as one day towards the 30 consecutive or 60 non-consecutive day requirement.
The ICM recognizes service members who are serving or have served in the country of Iraq and the contiguous water area out 12 nautical miles, and all air spaces above the land area of Iraq and above the contiguous water area out to 12 nautical miles of Iraq. Eligibility for the ICM requires service members to have served in direct support of OIF. The period of eligibility is on or after 9 Mar 03 to a future date to be determined by the Secretary of Defense or the cessation of OIF. Service members must have been assigned, attached, or mobilized to units operating in the area of eligibility for 30 consecutive days or for 60 non-consecutive days, while participating as a regularly assigned aircrew member flying sorties into, out of, within or over the area of eligibility in direct support of the military operations; each day of the operations counts as one day of eligibility.

AIR FORCE EVALUATION:
HQ AFPC/DPSIDR recommends denial. DPSIDR states they were unable to verify the applicant served the minimum number of days required as an aircrew member in the area of eligibility for award of the ACM or ICM. A review of the flight records submitted by the applicant reflects he acquired five (5) non-consecutive flying days into the area of eligibility for award of the ACM and nine (9) non-consecutive flying days into the area of eligibility for award of the ICM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 12 Nov 10 for review and comment within 30 days (Exhibit D). As of this date, this office has not received a response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error or injustice. Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application.
4. The applicant's case is adequately documented and it has not been shown that a personal appearance with or without counsel will materially add to our understanding of the issues involved. Therefore, the request for a hearing is not favorably considered.

The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
