APPLICANT REQUESTS THAT:

His records be corrected to show he was awarded the Air  Force  Commendation
Medal (AFCM).

APPLICANT CONTENDS THAT:

He should be awarded  the  AFCM  based  on  his  excellent  performance  and
dedication of duty while in Vietnam and Korea; as well  as  his  exceptional
willingness  to  accept  responsibility  and  overcome   obstacles   usually
reserved for airman of a higher rank and experience.  During the  period  in
question, he served his country with honor, integrity, dedication  and  with
an exceptionally high degree of professionalism.

In support of his request, the applicant submits  a  copy  of  his  DD  214,
copies  of  airman  performance  reports,  and  a  copy  of  a   letter   of
appreciation.

The applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

On 7 Sep 76, the  applicant  was  honorably  discharged  and  released  from
active duty in the grade of sergeant.  He  was  credited  with  5  years,  5
months and 12 days of total active service to include 1 year, 10 months  and
11 days of Foreign Service.

The applicant’s records indicate he was assigned to  duties  in  Kunsan  Air
Base, Korea from 28 Aug 75 to 29 Mar 76 where he performed duties as an  Air
Traffic Control Operator.

AIR FORCE EVALUATION:

HQ AFPC/DPPPR recommends denial.  DPPPR states the AFCM  was  authorized  by
the Secretary of the Air Force on 28 Mar 58 for  award  to  members  of  the
Armed Forces of the Unites States who, while serving in  any  capacity  with
the Air Force after 24  Mar  58,  shall  have  distinguished  themselves  by
meritorious achievement or service.

DPPPR states they were unable to verify recommendation of or receipt of  the
AFCM in the applicant’s records.  DPPPR asserts recommendation of  the  AFCM
must meet two criteria:

      1)  be made by someone other than the member, in  the  member’s  chain
of command at the time of the incident, and, who has firsthand knowledge  of
the acts or achievements; and,

      2)  be  submitted  through  a  congressional  member  who  can  ask  a
military service to review a proposal for a decoration based on  the  merits
of the  proposal  and  the  award  criteria  in  existence  when  the  event
occurred.

DPPPR was able to verify  the  applicant’s  entitlement  to  the  Air  Force
Outstanding Unit Award with Valor and  1  Oak  Leaf  Cluster  (AFOUA  w/V  &
1OLC), the Vietnam Service Medal with 3 Bronze Service Stars  (VSM  w/3BSS),
the republic of Vietnam Gallantry Cross  with  Palm  (RVNGC  w/P),  and  the
Republic of Vietnam Campaign medal (RVNCM).

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force  evaluation  was  forwarded  to  the  applicant  for
review and comment on 9 Jan 07.  As of this date, this office  has  received
no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  After a thorough review of  the  available
evidence and the applicant’s complete submission, we are not persuaded  that
his records should be corrected to show he is entitled to the award  of  the
Air Force Commendation Medal.  Other than his own assertions, the  applicant
has provided no documentary evidence that would  establish  his  entitlement
to the above-cited award.  We are not unmindful  or  unappreciative  of  his
service to his Nation.  However, in  the  absence  of  documentary  evidence
that, in our view, successfully refutes the  Air  Force  assessment  of  his
case, we have no basis on which to favorably consider this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
