APPLICANT REQUESTS THAT:

He be reinstated into Undergraduate Pilot Training (UPT) without re-
competing at the UPT selection board and if not, to be  granted  an
age waiver.

APPLICANT CONTENDS THAT:

He competed and earned a  pilot  slot  in  the  fall  of  02  while
attending the US Air  Force  Academy.   He  was  disqualified  from
Flying Class I (FCI) duties on 23 Apr 04, after sustaining injuries
in a car accident.  It took 29 months to recover and  complete  the
medical process for requalification.  He returned to FCI status  on
10 Mar 06.  Re-competing at the Feb 07  UPT  selection  board  will
force him over the age limit; his 30th birthday is 12 Oct  06.   He
earned a pilot slot in 02 and respectfully request that a  slot  be
reinstated.

In support of  his  appeal,  applicant  submitted  a  copy  of  his
Aeromedical Summary, dated 16 Feb 06; Standard Form 88,  Report  of
Medical Examination, dated 6 Feb  06;  a  copy  of  AF  Form  1042,
Medical Recommendation for  Flying  or  Special  Operational  Duty,
dated 17 Mar 06, and a letter of recommendation and  support  from,
Director of Strategic Planning, dated 6 Jun 06.

STATEMENT OF FACTS:

Applicant was commissioned in the Regular  Air  Force  and  entered
extended active duty (EAD) on 28  May  03.   He  was  progressively
promoted to the grade of first lieutenant with  an  effective  date
and date of rank (DOR) of 28 May 05.  He is current Duty  Title  is
Project Engineer GPS UE Sustainment, and his date of birth (DOB) is
12 Oct 76.

AIR FORCE EVALUATION:

HQ AFPC/DPAOT recommended denial with respect to  reinstatement  of
his pilot slot; however, they support granting  an  age  waiver  to
allow the applicant to compete for a pilot  training  slot  on  the
next available active duty selection board,  tentatively  scheduled
for Jan 07.

DPAOT consensus is that if an individual earned  a  pilot  training
slot, is  found  medically  disqualified  and  then  medically  re-
qualified within a 1 year  period,  every  effort  is  expended  to
provide administrative relief and return the pilot  training  slot.
In the applicant’s case, it has been  in  excess  of  that  1  year
window before he was medically certified for FC1 duties.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  the  applicant
on 14 Apr 06 for review and comment within 30  days.   As  of  this
date, no response has been received by this office (Exhibit C).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing
law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to  demonstrate
the existence of error or injustice.  After  careful  consideration
of the evidence of record and that provided by  the  applicant,  we
believe some form of relief is warranted.  The  applicant  requests
that his pilot slot be reinstated.  He contends  that  he  competed
and earned a pilot  slot  in  the  fall  of  02;  however,  he  was
disqualified from FC1 duties, after sustaining injuries as a result
of a car accident.  It appears that it took the applicant 29 months
to recover and complete the medical  process  for  requalification.
Therefore,  we  agree  with  the  recommendation  of  the   Deputy,
Operations Assignments Division, that the applicant be  granted  an
age waiver and that he be allowed to compete for a  pilot  training
slot  on  the  next  available   active   duty   selection   board.
Accordingly, we recommend that his  records  be  corrected  to  the
extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the  Air  Force
relating to APPLICANT, be corrected to allow  him  to  compete  for
Undergraduate Pilot Training at the next available  board  and,  if
accepted, he be granted an age waiver.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:

      The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to allow him to
compete for Undergraduate Pilot Training at the next available
board and, if accepted, he be granted an age waiver.
