APPLICANT REQUESTS THAT:

The AFROTC Pilot Training slot she was awarded be  reinstated  due  to
medical record update.

APPLICANT CONTENDS THAT:

She was granted a pilot slot pending  medical  evaluation.  Her  first
medical records were lost and the  second  exam  was  filed  under  an
incorrect SSN. After  this  was  corrected,  she  was  issued  a  FC1A
physical and recategorized to navigator  but  there  was  insufficient
time to contest the findings of the examination prior to active  duty.
Since commissioning, she has obtained the necessary waivers to correct
the disqualifying  parts  of  her  medical  record.  She  is  now  FC1
qualified and  seeks  to  regain  the  previously  issued  pilot  slot
allocation.

In support of her request, applicant provided  a  copy  of  AETC  Form
127A, Introductory Flight Training  Enrollment,  Aeromedical  Summary,
and medical records.

STATEMENT OF FACTS:

The applicant was commissioned as a  2nd  lieutenant  on       30  September
2005 through the AFROTC program at the University of Puerto Rico.

On 29 June 2005, the applicant was erroneously offered a  pilot  slot.
When the error was discovered seven days later, she was reverted to  a
navigator slot on 6 July 2005. She was explained the error was in  the
detachment submitting her for a pilot slot, when  she  had  previously
been identified as being below height minimums.

However,  subsequent  to  her   commissioning,   she   was   medically
disqualified during a 19 July 2005 Flying Class 1 physical  for  three
potentially disqualifying conditions.

The  applicant  was  not  medically  certified  for  pilot  duties  by
AETC/SGPS until 5 April 2006, and only then after  AETC/DO  granted  a
sitting height waiver on 31 March 2006.

AIR FORCE EVALUATION:

AFOATS/JA recommends denial and states she  is  no  longer  an  AFROTC
Cadet and cannot be offered a pilot slot from this  pool.   The  pilot
slot offered was originally erroneous and therefore, not valid.

AFOATS/JA's complete copy of the evaluation is at Exhibit C.

AFPC/DPAO makes no recommendation regarding the pilot training slot as
HQ AFROTC conducted that selection board and  is  outside  the  active
duty process; however, they would  recommend  the  applicant  complete
navigator training as she  was  assessed  into  the  Air  Force  as  a
navigator. Upon completion  of  navigator  training  and  serving  the
required two and a half years rated duty,  she  may  apply  for  pilot
training on the active duty selection board.  Based  on  her  age  and
commissioned service she could complete on one perhaps  two  selection
boards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
16 May 2006 for review and comment within 30 days.  As of  this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.


3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of an  error  or  injustice.   We  took  notice  of  the
applicant's complete submission in judging the  merits  of  the  case;
however,  we  are  not  persuaded  by  the  evidence  submitted   that
appropriate standards or procedures were not applied, or that she  was
denied any of the rights and privileges she was entitled to.  In  this
respect, we note the applicant was erroneously offered a pilot slot by
AFROTC while medically unqualified. When  the  error  was  discovered,
officials re-categorized her to a navigator  slot.  Since  she  is  no
longer an AFROTC Cadet, she cannot be offered a pilot slot from  their
available slots.   However,  since  commissioning,  she  has  obtained
waivers  to  correct  her  disqualifying  medical  records  and   upon
completion of navigator training and serving the required  two  and  a
half years rated duty, she may apply for pilot training on the  active
duty selection board.  Therefore,  we  agree  with  the  opinions  and
recommendations of the Air Force offices of primary responsibility and
adopt their rationale  as  the  basis  for  our  conclusion  that  the
applicant has not been the victim of an error or  injustice.   In  the
absence of evidence to the contrary, we find no  compelling  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
