APPLICANT REQUESTS THAT:

Twenty (20) days of leave be restored.

APPLICANT CONTENDS THAT:

She was applying for an exception to policy for  permissive  temporary
duty (PTDY); however, her request did not get approved  prior  to  the
start of her leave date.

The applicant’s complete submission, with attachments, is  at  Exhibit
A.

STATEMENT OF FACTS:

AFI 36-3003, Table 7, Rule 33 indicates  that  a  unit  commander  may
approve PTDY for up to 30 days if a member requests it to  participate
or train in sports, recreation and talent events officially  conducted
or  sponsored  by   elements   of   the   Air   Force,   inter-Service
organizations, or DOD, or to participate  in  regional,  national,  or
international sports events pre-approved by HQ  AFSVA/SVPAF.   Section
F, paragraph 12.2. instructs unit commanders to send, as an  exception
to policy, requests for PTDY reasons not found in Table 7 or paragraph
12.8.  through   command   channels   (the   Major   Command   submits
recommendations  and  reasons  for  approval  or  disapproval)  to  HQ
AFPC/DPFFOC for a  recommendation  and  to  HQ  USAF/DP  for  a  final
determination.  Requests are to be submitted  early  enough  to  allow
sufficient time for processing.

The applicant is currently serving in the Regular  Air  Force  in  the
grade of airman first class (A1C).

She  apparently  was  selected  to  tour  with  the  Women’s  National
Basketball Association (WNBA)  Houston  Comets  exhibition  team  from
28 Oct to 16 Nov 05.  The available documentation  does  not  indicate
when she was selected/notified.

Around 25 Oct 05, the applicant’s section commander requested that she
be approved for PTDY as an exception to policy (AFI 36-3003, Table  7,
Rule 33, participation in sports, recreation and talent events).   The
wing commander approved the request on 26 Oct 05.

According to Emails provided by the applicant, her squadron was unable
to get the PTDY package processed/approved prior  to  her  leaving  to
tour with the team.  Around 3 Nov 05, her unit inquired  with  Pacific
Air Forces (PACAF) as to the  status  of  the  package.   The  request
apparently was forwarded to and denied  by  HQ  AFPC  because  it  was
submitted  after  the  applicant  left  on   ordinary   leave   and/or
insufficient time was allowed for staffing.

The applicant was approved for and used 20 days of leave while on  the
tour during Fiscal Year 2006 (FY06).

AIR FORCE EVALUATION:

HQ  AFPC/DPF  recommends  denial  because  the   applicant   was   not
representing the Air Force in a DOD-sanctioned event or role.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air  Force  evaluation  was  forwarded  to  the
applicant on 31 Mar 06 for review and comment within 30 days  (Exhibit
C).  As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been presented  to  demonstrate
the existence of error or injustice to warrant restoring  20  days  of
leave to the applicant’s account.  The applicant was selected to  tour
with the WNBA Houston Comets exhibition team from 28 Oct to 16 Nov 05.
 Her section and wing commanders supported her request for PTDY as  an
exception to policy.  However, due to the short notice selection,  her
squadron was unable to obtain approval for the PTDY package  prior  to
her  departure  with  the  tour.   As  indicated  in  the  commanders’
supporting statements, allowing the applicant to tour in  PTDY  status
acknowledges her talent and instills pride in the services.  Had there
been sufficient time for processing, we are  confident  the  applicant
would have been allowed to tour during 28 Oct and 16 Nov  05  in  PTDY
status.  Therefore, we recommend the applicant’s records be  corrected
to reflect 20 days of leave were added to her current leave account.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to the APPLICANT be corrected to show that twenty  (20)  days
of leave were added to her current leave account.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to show that twenty
(20) days of leave were added to her current leave account.
