APPLICANT REQUESTS THAT:
Twenty-six (26) days of leave lost at the end of Fiscal Year 2005
(FY05) due to temporary duty (TDY) be restored.

APPLICANT CONTENDS THAT:
The applicant’s 16th Special Operations Squadron and Group commanders
support his request for restoration of 26 days of leave lost due to
mission requirements.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the
grade of lieutenant colonel.
According to HQ AFPC/DPF, the applicant carried forward 60 days of
leave at the beginning of FY05, and earned 30 days of leave. He used
six days of leave during FY05. He was deployed to Al Udeid Air Base
from 29 Jul 05 to 22 Sep 05 for a total of 56 days. The applicant
lost 24 days of leave at the end of FY05 on 30 Sep 05.

AIR FORCE EVALUATION:
HQ AFPC/DPF recommends partial relief by restoring 17 days of leave.
They contend the applicant lost 24, not 26, days of leave at the end
of FY05, according to the military pay system. Although the applicant
was notified of a short notice deployment, he returned in time to take
the other seven days of leave.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the
applicant on 14 Apr 06 (Exhibit C) for review and comment within 30
days. As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of error or injustice to warrant partial relief. The
applicant is requesting restoration of 26 days of lost leave; however,
HQ AFPC/DPF advises he lost only 24 days. They recommend 17 days of
leave be restored because the applicant returned in time from his
short-notice deployment to take seven days of leave before FY05 ended.
We note the applicant was deployed from 29 Jul to 22 Sep 05. This
left him only eight days to use seven days of leave before year-end
balancing. While the applicant may have been able to use some leave,
we believe it may have been difficult for him to take the full seven
days of leave immediately after returning from a 56-day deployment.
We therefore recommend a compromise in the form of adding 20 days of
leave to the applicant’s leave account. Further, since FY06 is almost
over and sufficient time must be allowed for processing, we recommend
the leave be added to his FY07 account commencing 1 Oct 06.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to the APPLICANT be corrected to show that twenty (20) days
of leave were added to his account commencing 1 October 2006.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to XXXXXXX, XXXXXXX, be corrected to show that twenty
(20) days of leave were added to his account commencing 1 October
2006.
