APPLICANT REQUESTS THAT:

He be awarded the National Defense Service Medal (NDSM), Small  Arms  Expert
Marksmanship Ribbon (SAEMR) with one bronze service star, and the Air  Force
Outstanding Unit Award (AFOUA).

APPLICANT CONTENDS THAT:

He served from 18 July 1988 to 21 September 1990.  The NDSM was  awarded  to
those who served from 2 August 1990  to  30  November  1995.   At  the  3292
Student Squadron, Lackland AFB and 9th Security Police Squadron  (9th  SPS),
Beale, AFB, he achieved expert marksmanship with the rifle in 1988 and  with
the pistol in 1989.  A review of his training records should  clarify  these
assertions.  In 1989, the 9th  Security  Police  Squadron  was  awarded  the
outstanding unit of the 3292 Student Squadron.  The service of the  men  and
woman in the armed services is so important, he feels that all members  past
and present should be recognized for their  achievements,  to  do  otherwise
would be a grave injustice.

STATEMENT OF FACTS:

The applicant enlisted in the Regular Air  Force  on  19  July  1988  for  a
period  of  six  years.   On  21  September  1990  he  was  administratively
discharged under AFR 39-10 (Misconduct-Pattern Conduct Prejudicial  to  Good
Order and Discipline).  He received a general (under  honorable  conditions)
discharge.  He was credited with two years, two months  and  three  days  of
active military service.

AIR FORCE EVALUATION:

AFPC/DPPPR, reviewed the application and verified  his  entitlement  to  the
National Defense Service Medal, and indicated that it has been added to  his
DD Form 214.  DPPPR indicates there was  no  documentation  in  his  records
showing he qualified as expert with any weapon or that he  was  assigned  to
the 9th SPS at Beale, AFB.  Without official documents showing he  qualified
as expert with a handgun or M-16, DPPPR is unable to verify his  eligibility
for award of the SAEMR.  Without documentation showing he  was  assigned  to
the 9th SPS, DPPPR is unable to verify his  eligibility  for  award  of  the
AFOUA.  The 814th SPS did not earn any unit awards while he  was  on  active

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air Force evaluation was forwarded to  the  applicant
on 13 February 2004, for review and response within 30  days.   As  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of error or injustice that would warrant some  corrective  action.
Applicant requests award of the NDSM, AFOUA, and the SAEMR.   We  note  that
his records have been corrected to reflect  award  of  the  NDSM.   After  a
review of the evidence of record, we believe that correction of his  records
to reflect award of the AFOUA is warranted as well.  In  this  respect,  the
AFOUA was awarded to the 9th SPS,  Beale  AFB,  for  the  period  1  Jul  89
through 31 Dec 89.  AF Form 2096  Classification/On-The-Job  Training  dated
22 August 1989 contained in his records indicated he was  assigned  to  that
unit during the period of the AFOUA  was  awarded.   Therefore,  it  is  our
opinion that his records should be corrected to reflect award of the  AFOUA.


4.  Regarding his request for award of the SAEMR, we found no  documentation
in his record, nor has  the  applicant  provided  any  documentation,  which
would support his contention that he achieved  expert  marksmanship  ratings
with  any  of  the  qualifying  weapons.   Should  he  provide  the   proper
documentation, we would  be  willing  to  reconsider  that  portion  of  his
request.  Therefore, we recommend that his records be corrected only to  the
extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that on 31 December 1989, he  was  awarded
the Air Force Outstanding Unit Award.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 31 December 1989, he
was awarded the Air Force Outstanding Unit Award.
