APPLICANT REQUESTS THAT:
His correct grade be restored.

APPLICANT CONTENDS THAT:
He was improperly removed from the lieutenant colonel promotion list in
1981 or 1982. Several people have mentioned that they believe he was
promoted and then removed without his knowledge. He has repressed this
thought for many years and would like vindication and restoration of his
correct pay grade.
Applicant provides no supporting documentation. His submission is at
Exhibit A.

STATEMENT OF FACTS:
On 30 September 1983, the applicant was relieved from active duty and
retired in the grade of major effective 1 October 1983 (Retirement for
Years of Service Established by Law). Applicant was credited with
20 years, 1 month and 24 days of total active duty service for basic pay
and active service for retirement.

AIR FORCE EVALUATION:
AFPC/DPPPO recommends the application be denied. DPPPO states the
applicant retired from active duty as a major on 1 October 1983. Based on
his date of rank of major effective 27 June 1973, he was eligible to meet
the T05 CY78 (21 August 78), T05 CY79 (20 August 1979), T05 CY80 (21 July
1980), T05 CY81 (2 February 1981) and T05 CY82 (26 July 1982) Lieutenant
Colonel Central Selection Boards. and was a nonselect. DPPPO advises the
applicant was a nonselect for these boards and had be been removed from a
list, a copy of the removal would have been a permanent part of his master
personnel record. A review of his master personnel record did not reveal
any derogatory information which could have been used as a basis for
removal action. The AFPC/DPPPO evaluation is at Exhibit C.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:
On 17 February 2006, a copy of the Air Force evaluation was sent to the
applicant for review and comment. As of this date, this office has not
received a response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. After a thorough review of the evidence
of record, we are not persuaded that the applicant’s record should be
corrected to reflect the grade of lieutenant colonel. Applicant’s
contentions are duly noted; however, we do not find these uncorroborated
assertions, in and by themselves, sufficiently persuasive to override the
evidence of record or the rationale provided by the Air Force office of
primary responsibility. We therefore agree with their recommendation and
adopt the rationale expressed as the basis for our decision that the
applicant has failed to sustain his burden that he has suffered either an
error or an injustice. Therefore, we find no basis to recommend granting
the relief sought.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.

His two Air Medals (AM) were absent from his OSR. This action took five months to complete; not timely processing. However, noting the Air Force's assessment that the correct duty title was reflected on his OPR covering the contested period and therefore, available to the selection board members, and finding no persuasive evidence that this discrepancy in and of itself, caused his nonselection for promotion, we agree with the Air Force that SSB consideration was not warranted.
