APPLICANT REQUESTS THAT:

He receive Special Selection Board (SSB)  consideration  by  the  lieutenant
colonel selection boards from 1977 to 1983.

APPLICANT CONTENDS THAT:

His completion of Air Command and Staff College (ACSC) in November 1977  may
not have been available for evaluation by any of the promotion  boards  from
1977 to 1983.

In support of his request, applicant  provides  a  copy  of  HQ  AFPC/DPPRSP
letter dated 19 June 2003,  correcting  his  DD  Form  214  to  reflect  the
completion of ACSC in  November  1977.   The  applicant’s  submission,  with
attachments, is at Exhibit A.

STATEMENT OF FACTS:

On 31 May 1983, the applicant was relieved from active duty and retired  in
the grade of major effective 1 June 1983.  He was credited  with  20  years
and 24 days of total active duty service for basic pay and  active  service
for retirement.

Applicant was considered and nonselected  for  promotion  to  the  grade  of
lieutenant colonel by the CY78 (21 August 1978), CY79 (20 August  1979),  CY
80 (21 July 1980, CY81 (2 February 1981) and CY82 (26 July 1982).

On 19 June 2003, after a review of his available military personnel  record,
the Separation Procedures Branch, corrected the applicant's DD Form  214  to
reflect the completion of ACSC in November 1977.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the application be denied.   DPPPO  provides  OSBs  as
evidence that an error did not exist in the applicant's record when  it  met
the respective promotion boards.  DPPPO  states  that  since  the  applicant
retired on 31 May 1983, he was not eligible to meet the  CY83  (28  November
1983) board.  The AFPC/DPPPO evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 9 July 2004, a copy of the Air Force  evaluation  was  forwarded  to  the
applicant for review  and  comment.   As  of  this  date,  this  office  has
received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  The applicant asserts that his  completion
of Air Command and Staff College (ACSC) in November 1977 may not  have  been
considered for evaluation  by  the  1977  through  1983  lieutenant  colonel
selection boards.  However, it appears that  his  ACSC  completion  was,  in
fact, reflected on his Officer Selection Briefs beginning with the CY78  and
ending with the CY82 lieutenant colonel selection boards.  In  our  opinion,
the Air Force office of primary responsibility has adequately addressed  his
contention and we are in  agreement  with  their  assessment  of  his  case.
Therefore, in the absence of evidence by the applicant that refutes the  Air
Force evaluation of his case, we  find  no  compelling  basis  to  recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
