APPLICANT REQUESTS THAT:
He be considered for promotion to lieutenant colonel by a Special
Selection Board (SSB) for the CY98B (1 Jun 98) Central Lieutenant
Colonel Selection Board, with inclusion of the citation for the Air
Force Commendation Medal, 1st Oak Leaf Cluster (AFCM 1OLC) in his
Officer Selection Record (OSR).

APPLICANT CONTENDS THAT:
The citation was missing from his records when he met the CY98B
selection board. The error was discovered during his nonselect record
review. His preselection briefs have always reflected the correct
number of decorations and the citation/order was part of his local
military personnel flight (MPF) records. He believes this missing
decoration could have been interpreted as below average performance
while assigned at Kadena and a contributing factor for his
nonselection to lieutenant colonel.
In support of his request, applicant submits copies of the citation
for the AFCM 1OLC, Special Order, and a letter from his local MPF
(Exhibit A).

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) reveals the
applicant’s Total Active Federal Military Service Date (TAFMSD) as 15
April 1982. He is currently serving on active duty in the grade of
major, with an effective date and date of rank of 1 May 1994.
The applicant was awarded the Air Force Commendation Medal 1st Oak
Leaf Cluster (AFCM 1OLC) by Special Order, dated 23 April 1991, for
meritorious service while assigned at Kadena Air Base during the
period 18 Jul 85 to 30 Sep 90.

AIR FORCE EVALUATION:
The Directorate of Personnel Program Management, HQ AFPC/DPPPA,
reviewed this application and recommended denial. DPPPA stated that
although the citation for the AFCM 1OLC was missing from the
applicant’s officer selection record (OSR) when he was considered for
promotion by the CY98B selection board, it was properly annotated on
his officer selection brief (OSB). The AFCM 1OLC was properly
annotated on his OSB, therefore, the board members were knowledgeable
the decoration was given, which is the ultimate purpose for including
them in the promotion selection process. DPPPA is confident the board
members were aware the applicant had been awarded an AFCM 1OLC and
factored it into their promotion evaluation of the applicant.
A complete copy of this evaluation is appended at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to applicant on 14
December 1998 for review and response. As of this date, no response
has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of probable error or injustice. While the citation
accompanying the Air Force Commendation, 1st Oak Leaf Cluster, was
missing from applicant’s records at the time he was considered for
promotion by the CY98B Central Lieutenant Colonel Selection Board, the
decoration was annotated on his Officer Selection Brief (OSB) and the
selection board members had knowledge of this award. We do not find
the fact that the cited information was not included in his Officer
Selection Record (OSR), in and of itself, warrants approval of the
requested relief. Central selection boards evaluate the entire
officer record. We have seen no evidence showing to our satisfaction
that the applicant’s record was so inaccurate and misleading that the
duly constituted selection board was unable to make a reasonable
decision concerning his promotability in relation to his peers,
particularly since the award was cited on his OSB for the board’s
review. In view of the foregoing, the applicant’s request for SSB
consideration is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of probable material error or injustice;
that the application was denied without a personal appearance; and
that the application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.

They now agree with the applicant and do not believe the CY97C central board had the opportunity to review the AAM, 2OLC, citation; however, the citation was not required to be filed until after the board convened on 21 June 1997. Even though the AFAM 1OLC citation was not on file for the board, it was in evidence before the board as he points out, on his OSB. Since the board members were aware of the AFAM 1OLC, they are convinced it was factored into the applicant’s promotion evaluation.
With regard to the applicant’s request to correct the Assignment History section on the Officer Selection Brief (OSB) reviewed by the CY98B promotion board, we note that AFPC/DPAPS1 concurs with the applicant that the duty titles for 6 May 1991 and 1 October 1991 as reflects “Mechanical Engineer” are incorrect and should be deleted.
