APPLICANT REQUESTS THAT:

His Officer Selection  Brief  (OSB),  duty  title  section,  be  changed  to
reflect his current duty title which was  effective  15 June  2005  and  his
award of the Defense Meritorious Service Medal  (DMSM)  for  the  period  12
April 2003 to 10 June 2005 be considered by a Special Selection Board  (SSB)
for the CY05A Lieutenant Colonel Central Selection Board (CSB).

APPLICANT CONTENDS THAT:

He was awarded a DMSM upon his permanent change of station on 10 June  2005,
a month prior to the convening of the CY05A  Lieutenant  Colonel  CSB.   His
duty  history  reflected  he   was   still   stationed   at   the   National
Reconnaissance Office in June 2005 when  he  was  already  assigned  to  the
United States Strategic Command at Offutt AFB effective 15 June 2005.   This
duty title error sends a message that he was “homesteading.”

In support of his request, applicant  provides  copies  of  his  DMSM  award
package, PCS orders and his duty history;  and  supporting  statements  from
his former and present additional raters.  The applicant’s submission,  with
attachments, is at Exhibit A.

STATEMENT OF FACTS:

Information extracted from the Military Personnel Data System indicates the
applicant’s Total Active Federal Military  Service  Date  as  19  September
1990.  He is currently serving on active duty in the grade of major, with a
date of rank of 1 September 2001.

The  applicant’s  OSB  contains  AF  Forms  707B,  Company  Grade   Officer
Performance Reports, beginning with the rating period  20  April  2000  and
ending 30 August 2001  with  overall  ratings  of  “Meets  Standards.”   In
addition, the applicant’s OSB contains AF Forms 707A, Field  Grade  Officer
Performance Reports, (OPRs) beginning with the rating period 31 August 2001
and ending on 11 April 2005 with overall ratings of “Meets Standards.”  The
applicant’s OSR indicates he was awarded one Air  Force  Achievement  Medal
for the period  10  July  1995  –  12  December  1996,  two  Joint  Service
Achievement Medals for the periods 23 April 2000 to 28 February 2001 and  1
March  2001  to  27  February  2003.   He  also  received  two  Air   Force
Commendation Medals for the periods 4 February 1991 to 1 July 1995, and  15
December 1996 to 20 April 2000.

The applicant has one nonselection to the grade of  lieutenant  colonel  by
the CY05A (6 Jul 05) (P0505A) Lieutenant Colonel CSB.

AIR FORCE EVALUATION:

AFPC/DPPPO recommends the duty title entry be corrected  and  his  corrected
OSB meet an SSB.  DPPPO states that since the duty title was  not  reflected
any where else in his  record,  the  board  members  did  not  know  of  its
existence  to  factor  it  into  the  promotion  selection  process.   DPPPO
recommends denial of the Defense Meritorious Service  Medal  (DMSM).   DPPPO
states the  applicant’s  DMSM  order  was  published  on  18  October  2005,
therefore, the citation could not have been filed in  his  selection  record
nor reflected  in  any  official  personnel  data  systems  when  the  board
convened on 6 July 2005.  The AFPC/DPPPO evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 2 December 2005, a copy of the Air  Force  evaluation  was  sent  to  the
applicant for review and comment.  As of this  date,  this  office  has  not
received a response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence  has  been  presented  to  demonstrate  the
existence of error or injustice.  Based on the evaluation  provided  by  the
Air Force office of primary responsibility we agree  there  are  grounds  to
correct the applicant’s record.   With  respect  to  the  duty  title  entry
effective 15 June 2005; it appears that through no fault  of  his  own,  the
applicant’s record was incorrect at the time he was considered by the  CY05A
central lieutenant colonel selection board.  Therefore,  his  record  should
be corrected to include this information.

4.  As to the request to  include  the  Defense  Meritorious  Service  Medal
(DMSM) for the period 12 April 2003 to 10 June 2005, we believe this  relief
should also be granted.   Given  the  support  he  received  by  his  former
commander, and having no reason to doubt his integrity in  this  matter,  we
believe the applicant was improperly disadvantaged due to the absence of  an
end-of-tour award and could have possibly presented a  false  impression  to
the promotion board  that  an  end-of-tour  award  was  not  earned  by  the
applicant and, possibly, could have affected the perceptions  of  the  board
members.  In view of this fact  and  because  of  the  other  correction  we
propose, to preclude any possible injustice to the applicant, his  selection
record should be changed to show this award was accepted for file  prior  to
the board convening date.

5.  We have no way of knowing the impact the above  corrections  would  have
had on the applicant’s promotion opportunities when presented to  the  CY05A
Lieutenant Colonel Central Selection Board.  Therefore, in order  to  afford
the applicant full and complete relief and to  resolve  any  doubt  in  this
matter, his corrected record should  be  referred  to  a  Special  Selection
Board.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to APPLICANT be corrected to show that:

            a.  The Defense Meritorious Service Medal (DMSM) for the  period
12 April 2003 to  10  June  2005  was  accepted  for  file  in  his  Officer
Selection Brief (OSB) on or before 5 July 2005.

            b.  His Officer Selection Brief (OSB)  prepared  for  the  CY05A
Lieutenant Colonel Central Selection Board be amended to  reflect  his  duty
title entry effective 15 June 2005 .

      It is further recommended that he be considered for promotion  to  the
grade of lieutenant colonel by a  Special  Selection  Board  (SSB)  for  the
CY05A Lieutenant Colonel Central Selection Board.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to xxxxxxxxxxxxxxx, be corrected to show that:

            a.  The Defense Meritorious Service Medal (DMSM) for the period
12 April 2003 to 10 June 2005 was accepted for file in his Officer
Selection Brief (OSB) on or before 5 July 2005.

            b.  His Officer Selection Brief (OSB) prepared for the CY05A
Lieutenant Colonel Central Selection Board be amended to reflect his duty
title entry effective 15 June 2005.

      It is further recommended that he be considered for promotion to the
grade of lieutenant colonel by a Special Selection Board (SSB) for the
CY05A Lieutenant Colonel Central Selection Board.
