APPLICANT REQUESTS THAT:

He receive promotion consideration by Special  Selection  Board  (SSB)
for the Calendar Year (CY) 2005 (05) Colonel Central  Selection  Board
(CSB) with the inclusion of the I Class Meritorious Medal awarded  him
by the Honduran government.

APPLICANT CONTENDS THAT:

He was awarded and presented this decoration  in  May  2005,  but  the
orders were not provided by the  Honduran  government  until  December
2005, thus were not included in his Officer Selection Record (OSR).

Applicant's complete submission,  with  attachments,  is  attached  at
Exhibit A.

STATEMENT OF FACTS:

Applicant is  currently  serving  on  active  duty  in  the  grade  of
lieutenant colonel.

Applicant was considered but not selected for promotion to  the  grade
of colonel by the CY05A colonel CSB.

Applicant’s OPR profile as a lieutenant colonel is listed below.

AIR FORCE EVALUATION:

HQ  AFPC/DPPPOO   recommends   the   applicant’s   request   for   SSB
consideration be denied.  However, if the Board  grants  relief,  then
they recommend the applicant write a letter  to  the  board  president
identifying  the  decoration.   DPPPO  states  the  only   decorations
considered in the promotion process are those listed on  the  Military
Personnel Flight Memorandum (MPFM) 05-14 for the  CY05A  board.   This
decoration is not listed among  the  decorations  in  MPFM  05-14  and
therefore, inclusion of this citation is not authorized to be filed in
the applicant’s OSR nor  reflected  in  his  Officer  Selection  Brief
(OSB).  The only way to  ensure  the  board  members  were  aware  the
applicant received this decoration would have been to write  a  letter
to the board president.  They found no evidence the applicant  elected
to write a letter.

A copy of the Air Force evaluation is attached at Exhibit C.

HQ AFPC/DPPPR recommends the applicant’s  request  be  denied.   DPPPR
states they can only verify current awards  and  decorations  criteria
listed in  the  Department  of  Defense  (DOD)  1348.33-M,  Manual  of
Military Decorations and Awards or the Air Force Instruction (AFI) 36-
2803, The Air Force Awards  and  Decorations  Programs.   “Although  a
foreign government may label or consider an item to be  a  decoration,
that designation in itself does not mean the item shall be  considered
a decoration by the U.S. Government.”

A copy of the Air Force evaluation is attached, with an attachment, is
at Exhibit D.

APPLICANT'S REVIEW OF AIR STAFF EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
24 March 2006, for review and response.  As of this date, no  response
has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of an error or an injustice.  After thoroughly reviewing
the evidence of record and the  applicant’s  submission,  we  are  not
persuaded that the applicant  should  be  provided  consideration  for
promotion to the grade of colonel by an  SSB  for  the  Calendar  Year
2005A central selection board  with  the  inclusion  of  the  I  Class
Meritorious Service Medal.  Although the applicant  was  awarded  this
decoration by  the  Honduran  government,  it  is  not  an  authorized
decoration  for  inclusion  in  the  servicemember’s  OSR  nor  is  it
reflected on the OSB.  The applicant in  order  to  ensure  the  CY05A
board members were aware of  this  decoration  could  have  written  a
letter to the board president.   However,  we  find  no  evidence  the
applicant elected to write a letter identifying the decoration to  the
Board president.  Therefore, we agree with the recommendations of  the
Air Force and adopt their rationale expressed as  the  basis  for  our
conclusion  that  the  applicant  failed  to  sustain  his  burden  of
establishing  the  existence  of  either  an  error  or  an  injustice
warranting favorable action on these requests.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.

    The DPPPR evaluation is at Exhibit B. ARPC/DPPPO recommends the Board deny the applicant’s request for SSB consideration. It is the officer’s responsibility to ensure the accuracy of his record prior to the board convening date, not after he has been nonselected for promotion. After reviewing the evidence of record, we note the applicant’s OSR did not contain a copy of his DMSM citation, nor did his OSB reflect his award of his AAM/8OLC at the time the board convened.
