APPLICANT REQUESTS THAT:
Her deceased husband's records be corrected to show that he served in
Vietnam.

APPLICANT CONTENDS THAT:
Applicant makes no contentions. In support of her request, applicant
provided a copy of her husband's passport, a copy of his DD Form 214, his
death certificate, and a photo of her husband. Applicant's complete
submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The former member contracted his initial enlistment in the Regular Air
Force on 31 May 51. He was progressively promoted to the grade of
technical sergeant, having assumed that grade effective and with a date of
rank of 1 Dec 58. He voluntarily retired from the Air Force on 31 Aug 71,
having served 20 years, 3 months, and 1 day on active duty. During his
career, he served overseas assignments in Newfoundland, Philippines,
Alaska, and Thailand. He has been awarded the Vietnam Service Medal (VSM).
The VSM is awarded to service members who between 4 Jul 65 and 28 Mar 73,
served in Vietnam, Thailand, Laos, or Cambodia in the direct support of
military operations in Vietnam. He was stationed in Thailand from 1 Jan 70
through 17 Oct 70.

AIR FORCE EVALUATION:
AFPC/DPAPP recommends denial. DPAPP states the former member's records
confirm his overseas assignments but there are no documents that verify he
was PCS or TDY in Vietnam. The passport provided shows he had
authorization for entry into Vietnam; however, there are no dates showing
any entry or departure from Vietnam. Photographs are not used as source
documents to verify Vietnam service because there is no way to verify the
location of the radar site.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 2 Dec
05 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. After a thorough review of the
evidence presented and the available evidence of record, we find no
evidence which would lead us to believe that correction of the former
member's record to reflect service in Vietnam is warranted. We are not
ungrateful or unappreciative of his service to this nation; however, absent
the presence of official documentation showing that he served in the
Republic of Vietnam, the applicant's request cannot be favorably
considered. If the applicant were to obtain official documentation (i.e.
orders, travel voucher, etc.), we would be willing to reconsider her
request. In the absence of such evidence, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
