APPLICANT REQUESTS THAT:

His current posted AF Form  709,  Promotion  Recommendation  Form  (PRF)  be
removed from his promotion folder at the  Air  Force  Personnel  Center  and
replaced with  the  corrected  PRF  posted  in  his  file  for  the  Special
Selection Board (SSB) for CY04A Colonel Central Selection Board.

STATEMENT OF FACTS:

On 22 Feb 06, the Board considered his request and recommended  his  Officer
Performance Report (OPR) closing  19  Mar  04  be  voided  and  that  he  be
considered for promotion to the grade  of  colonel  by  SSB  for  the  CY04A
Colonel Central Selection Board.  (A copy  of  the  Record  of  Proceedings,
with exhibits, is at Exhibit F).

On 10 May 06, the applicant requested that his PRF  for  the  CY04A  Colonel
Central Selection Board  SSB  be  removed  from  his  promotion  folder  and
replaced with a new endorsed PRF.   His  Officer  Performance  Report  (OPR)
closing 19 Mar 04 was declared void and  removed  from  his  record  by  the
AFBCMR’s previous decision.  The OPR  contained  many  errors  in  fact  and
omitted data, creating  a  negative  perception  of  his  overall  promotion
records  during  the  management-level  review  (MLR)  in   Nov   04,   thus
facilitating marginal verbiage in the current posted PRF.  The  current  PRF
omitted stratification, major awards received and a career push  for  Senior
Development Education (SDE) attendance.  The applicant  provided  the  Board
with a corrected PRF endorsed by his Senior  Rater  (SR)  and  a  letter  of
concurrence from the MLR President.

In support of his appeal, applicant submitted a copy  of  his  original  PRF
for the CY04A board; new  endorsed  PRF;  a  copy  of  the  Management-Level
Review  letter  of  concurrence,  dated  25  Apr  06;  a  copy   of   AFBCMR
Recommendation, dated 9 Mar 06, and an extract from the  AFI  36-2401,  para
A1.6., dated 20 Feb 04,

AIR FORCE EVALUATION:

HQ AFPC/DPPPE reviewed this application and recommended denial.  This is  an
additional  request  to  the  AFBCMR.   The  AFBCMR  approved  voiding   the
applicant’s 20 Mar 04 OPR and granted an  SSB  promotion  consideration  for
CY04A.

The applicant provided a substitute report along with the  concurrence  from
his MLR President.  HQ AFPC/DPPEP returned the application to the  applicant
requesting a memo of concurrence from the Senior Rater (SR) as  directed  by
AFI 36-2401, table 3, rule 3.  The  PRF  contained  a  complete  rewrite  in
Section IV which required an explanation from the  SR  as  to  why  the  PRF
deserved to be completely rewritten.  The SR  later  provided  an  email  in
lieu of a memo stating he does not concur with the changes  to the  PRF  and
requests the current PRF remain in the applicant’s records.   The  SR  noted
the information from the 20 Mar 04 OPR (specifically line 8 stating  “11  WG
Tm of Yr Awd”) was mentioned in the applicant’s  Meritorious  Service  Medal
(MSM) for 24 Mar 02 – 1 Jul 04 and the PRF is an accurate assessment.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Having been provided the advisory  opinion,  the  applicant  reiterated  his
contentions that his previous PRF be declared void due to the removal  of  a
negative OPR closing 19 Mar 04, and should be replaced with a  new  endorsed
PRF.  The overall wording of the PRF is extremely important  to  members  of
the promotion board because it sets the initial  tone  critical  to  scoring
the officer’s records.  The PRF requested for removal was sabotaged  by  the
same former leadership that wrote  the  OPR  closing  19 Mar 04,  which  was
removed by the Board.

He requests that the Board not accept the recommendation of  DPPPE  to  keep
the poorly  written  PRF  in  the  corrected  records.   AFI  36-2401,  para
A1.5.1.2, states that SR and MLR president must carefully consider what,  if
any, the correction or change may have had on the final PRF content,  rating
or the final preparation content.  He enclosed an endorsed  PRF  by  the  SR
and an  endorsed  letter  of  concurrence  from  the  MLR  president.   Each
submitted after careful review of the entire corrected records.

He further explained the sequence of events  and  circumstances  surrounding
his corrected PRF and that without the negative OPR, the  positive  tone  of
the overall corrected record should be reflected as such in the new PRF.

In support of his response, he provided a personal statement and  copies  of
his last seven OPRs from 1 Feb 99 through 1 Feb 05.

THE BOARD CONCLUDES THAT:

Insufficient  relevant  evidence  has  been  presented  to  demonstrate  the
existence of error  or  injustice  regarding  the  applicant’s  request  for
additional consideration for promotion by SSB for the CY04A Colonel  Central
Selection Board with a  corrected  PRF.   The  applicant  believes  his  PRF
omitted stratification, major awards received and  a  career  push  for  SDE
attendance and that the  positive  tone  of  the  overall  corrected  record
should be reflected in the new PRF.   After  careful  consideration  of  the
comments of the Air Force and that provided  by  the  applicant,  the  Board
noted that although the SR initially endorsed the corrected PRF; it  appears
upon further review the SR no longer concurred with the changes to  the  PRF
and requested the current PRF remain in the applicant’s records.   Although,
the SR no longer concurs with the new endorsed  PRF,  the  applicant  had  a
letter of concurrence from the  Management  Level  Review  (MLR)  President,
which supported corrections to the applicant’s PRF.   The  Board  considered
the unique circumstances surrounding the applicant’s case;  nonetheless,  in
coming  to  it’s  decision,  they  noted  that  AFI  36-2401,  states   when
considering changes to section IV of the PRF,  the  senior  rater  needs  to
demonstrate a material error in the PRF; a material error in the  record  of
performance which substantially impacted  the  content  of  the  PRF;  or  a
material error in the  process  by  which  the  PRF  was  crafted.   In  all
instances, the requested change  to  section  IV  must  be  related  to  the
documented  error.   Appeals  to  rewrite  section  IV  simply  to   include
different,  but  previously  known   or   documented   accomplishments   are
inappropriate.  The applicant has failed to provide supporting documents  of
a  material  error  in  the  report.   The  information  the  applicant  has
requested the AFBCMR place in the PRF was previously  known  to  the  senior
rater.  The information  does  not  remove  negative  information  from  the
officer’s record or add positive information that was not previously  known.
 Therefore, after a thorough review of all  the  factors  presented  to  the
Board, we found no compelling evidence which  would  lead  us  to  recommend
favorable consideration of the applicant’s appeal.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
