APPLICANT REQUESTS THAT:
He be awarded the Distinguished Flying Cross (DFC).

STATEMENT OF FACTS:
Applicant’s initial request was considered and rejected as untimely by the
Board. (See the Record of Proceedings, dated 30 Jan 89, with attachments,
at Exhibit G).
A similar appeal was considered and denied by the Board on 17 Dec 03. (See
the Addendum to the Record of Proceedings, dated 28 Jan 04, with
attachments, at Exhibit H).
In his most recent submission, he requests that he be awarded the DFC for
flying combat missions during the Vietnam Conflict.
In support of his appeal, the applicant submitted a personal statement; a
copy of FAC News, along with other supporting documents and extracts from
his military records.

THE BOARD CONCLUDES THAT:
After again reviewing this application and the evidence provided in support
of the appeal, we remain unpersuaded that the applicant’s has met the
requirements for award of the DFC. We found no evidence substantiating
that the applicant was recommended for the requested award and that such a
recommendation was approved. The personal sacrifice the applicant endured
for his country is noted and our decision in no way diminishes the high
regard we have for his service; however, we found no evidence which would
persuade us to amend the earlier decision that the applicant has failed to
sustain his burden of having suffered either an error or injustice.
Therefore, in the absence of persuasive evidence to the contrary, we find
no compelling basis to recommend granting the relief sought in this
application.
The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issue involved. Therefore, the request for a
hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
