APPLICANT REQUESTS THAT:

It appears the applicant  is  requesting  that  the  inactive  duty
service recorded on his Air Force Reserve Point Credit Summary  for
the period 9 Nov 88 through 7 Dec 90, be changed to active duty.

APPLICANT CONTENDS THAT:

His records should reflect that he completed two  years  of  active
duty service as well as two years of inactive duty service  in  the
Air Force Reserve.

He has tried to contact his old units but the units have  all  been
deactivated.  He was referred to  the  National  Personnel  Records
Center (NPRC) and HQ Air Reserve Personnel  Center  (HQ  ARPC)  for
point credit data and  has  submitted  all  the  records  that  are
available.

STATEMENT OF FACTS:

Applicant’s AF Form 526, ANG/USAFR Point Credit  Summary,  reflects
that for Retirement Years Ending (RYE) 20 Jun 89,  90,  and  91,  a
total of 88 paid inactive duty points and 350  active  duty  points
were credited.

All of the active duty tours documented on the applicant’s AF Forms
938, Request and Authorization for Active Duty Training/Active Duty
Tour, are recorded on the point credit summaries.

AIR FORCE EVALUATION:

HQ ARPC/DPP  reviewed  this  application  and  recommended  denial.
Based on their analysis of  the  circumstances  of  the  case,  the
AF Form 526 for RYE 20 Jun 89, 90, and 91 shows inactive duty drill
dates totaling 88 paid inactive duty points.  These  paid  inactive
duty points, coded type duty 7, automatically posted to  the  Point
Credit Accounting and Reporting System (PCARS) from the Reserve Pay
Office and indicate that the applicant received pay for the  drills
performed.

The applicant’s active duty service documented on the DD Form  214,
Certificate of Release or Discharge from Active Duty for  Operation
Desert Shield/Storm from 8 Dec 90  through  5  Jul  91,  shows  194
active duty points on his AF Form 526 for RYE  20  Jun  91,  but  a
discrepancy was found on his  AF  Form  526  for  RYE  20  Jun  92.
Fourteen (14) active duty points from  22  Jun  -  5  Jul  91  were
missing along with eight  (8)  inactive  duty  points  for  13  and
14 Jul 91, and 10 and 11 Aug 91.  A corrected copy of the  AF  Form
526 for RYE 20 Jun 92  was  processed  to  reflect  the  additional
14 active duty points and 8 inactive duty points credited.

The applicant was credited with the proper active and inactive duty
points.  All the points and type duty codes were correctly recorded
on the point credit summaries.  In most  instances,  the  applicant
earned two inactive duty points per drill day.  During active duty,
only one point  can  be  earned  per  day.   Moreover,  the  source
documents provided by the applicant, verify active duty points were
correctly recorded on the point credit summaries and did not refute
the existing inactive duty points.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  the  applicant
on 29 Jul 05 for review and comment within 30  days.   As  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing
law or regulations.

2.  The application was not timely filed; however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.  Insufficient  relevant   evidence   has   been   presented   to
demonstrate  the  existence  of  error  or  injustice.    Applicant
contends that his records should  reflect  that  he  completed  two
years of active duty service as well as two years of inactive  duty
service  in  the  Air  Force  Reserve.   However,   after   careful
consideration of the documents submitted in support of  his  appeal
and the evidence  of  record,  it  appears  he  has  been  properly
credited  with  all  of  the  participation  performed  during  the
Retirement Years Ending 20 Jun 89, 90,  and  91,  both  active  and
inactive service.   IAW  AFM  36-8001,  Reserve  Participation  and
Training, one point should be awarded for a day of active duty  and
one point should  be  awarded  for  four  hours  of  inactive  duty
training, not to exceed two points per  day.   Active  duty  points
cannot be credited as inactive duty training.  Therefore, we  agree
with the opinion and recommendation of the  Air  Reserve  Personnel
Center and adopt its rationale as the basis for our conclusion that
the applicant has not been the victim of  an  error  or  injustice.
Based on the foregoing, and in  the  absence  of  evidence  to  the
contrary, we find no compelling basis  to  recommend  granting  the
relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified  that  the  evidence  presented  did  not
demonstrate the existence of material error or injustice; that  the
application was denied without a personal appearance; and that  the
application will only be reconsidered upon the submission of  newly
discovered relevant evidence not considered with this application.
