APPLICANT REQUESTS THAT:
1. His records be corrected to show Intermediate Developmental Education
(IDE) credit for Joint Military Intelligence College (JMIC) as of August
1994.
2. He be considered for promotion to the grade of lieutenant colonel by
Special Selection Board (SSB) for the Calendar Year 2003A (CY03A) Central
Lieutenant Colonel Selection Board.

STATEMENT OF FACTS:
On 8 Jul 05, the Board considered and denied a similar appeal. In his
previous submission, applicant contended that the Air Force changed the
policy for JMIC to IDE PME in-residence credit, grandfathered the credit
for Year Groups 1989 through 1994, and unfairly excluded Year Group 1988.
He completed JMIC early in his career and believes he should benefit from
the policy. Had the PME in-residence status been in his record at the time
his Promotion Recommendation Form was rendered, he believes he would have
received a "DP" recommendation. For an accounting of the facts and
circumstances surrounding the applicant’s request and the rationale of the
earlier decision by the Board, see the Record of Proceedings at Exhibit F.
In his most recent submission, applicant states the denial of his original
request was based on an inaccurate analysis provided by AFPC/DPAO. DPAO
believes it is justifiable to ignore his accomplishment and deny his in-
residence PME credit. DPAO concludes that completing the graduate-level
program as a captain was a waste of his time. He had no way of knowing it
would be to his advantage to have waited five years to attend JMICA as a
major. The Air Force's negligence in recognizing the importance of JMIC
for many years is not grounds or justification to exclude him from this
significant distinction. In support if his appeal, applicant provided a
personal statement, an Air Force News printout, AFSLMO Force Development
Briefing, a Public Affairs article, and a statement provided by his wing

THE BOARD CONCLUDES THAT:
1. After again reviewing this application and the additional evidence
provided in support of his appeal, we remain unpersuaded that the applicant
has been the victim of an error or injustice. After a thorough review of
the additional evidence provided, it is our opinion that the Air Force
policy regarding the award of IDE credit for JMIC is clear in its intent
and we believe it was appropriately determined that he does not meet the
criteria for award of IDE credit. Absent persuasive evidence that the
applicable rules were inappropriately applied or that he was denied rights
to which he was entitled, we do not find his assertions persuasive enough
to warrant reversal of our previous determination. Accordingly, we find no
basis upon which to favorably consider the requested relief.
2. The applicant's case is adequately documented and it has not been shown
that a personal appearance with or without counsel will materially add to
our understanding of the issue involved. Therefore, the request for a
hearing is not favorably considered.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; that the application was
denied without a personal appearance; and that the application will only be
reconsidered upon the submission of newly discovered relevant evidence not
considered with this application.
