APPLICANT REQUESTS THAT:
Her records be changed to reflect satisfactory service for
retention/retirement (R/R) year 15 October 2002 through 14 October
2003.

APPLICANT CONTENDS THAT:
In February 2003 she resigned from the 911th Airlift Wing (AW) in
hopes of being gained by the Pennsylvania Air National Guard (PAANG)
in the fall of 2003. Due to an administrative error transfer of her
medical records was delayed between the losing and gaining
organizations thereby delaying her enlistment. Consequently, and at
no fault of her own, she earned only 49 points of the 50 points
required to obtain a satisfactory year of service.
In support of her appeal, the applicant has provided a personal
statement and a letter of support from a PAANG recruiter.

STATEMENT OF FACTS:
The applicant, a current member of the PAANG, began her military
career on 15 October 1985. She attained the grade of technical
sergeant with a date of rank of 10 December 2004. She served with the
911th AW, Air Force Reserve (AFR), until her resignation from the AFR
in February 2003. Up to the time of her resignation she had earned 20
active duty points and 14 inactive duty points. Along with her 15
membership points, she was one point shy of the required 50 points
needed for R/R year of 15 October 2002 through 14 October 2003 to be a
satisfactory year of Federal service.
Approximately six months after submitting her resignation, on
25 August 2003, she was transferred to the Non-obligated, Non-
participating Ready Personnel Section (NNRPS). She did not
participate from the time she submitted her resignation to the time
she was actually transferred to the NNRPS approximately six months
later. She began the process of enlisting with the PAANG in October
2003 leaving her less than one month remaining in the current R/R with
which to earn the one point she needed. As a result of missing
medical records she was not able to complete her enlistment with the
PAANG and begin earning points until 23 January 2004, after the
affected R/R year had passed.
She is currently serving with the PAANG as a technical sergeant with
over 18 years of satisfactory service as of October 2004.

AIR FORCE EVALUATION:
HQ ARPC/DPP recommends denial. DPP states she did not serve during
the six months between her application for resignation and her actual
transfer to the NNRPS. DPP also notes she didn’t begin her enlistment
process with the PAANG until the final month of her R/R year leaving
her with too little time to earn the point she needed. DPP notes the
issue of missing medical records as the cause of her not earning her
final point with the PAANG in time is not relevant. They state, even
with medical records, she would not have been scheduled for her first
unit training assembly (UTA) with the PAANG until the November 2003
UTA period, a month past her 2002-2003 R/R year.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant contends she had every intention of participating during the
six months between her resignation request and her eventual transfer
to the NNRPS. However, the commander at the 911th AW had implemented
a policy that did not allow anyone that had resigned to participate
during the period prior to transfer to the NNRPS.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough review of the
evidence of record and applicant's submission, we are not persuaded
that her uncorroborated assertions her commander would not allow her
to perform UTA’s for the six months prior to her resignation and
missing medical records, in and by themselves, sufficiently persuasive
to override the rationale provided by the Air Force. Therefore, we
agree with the opinion and recommendation of the Air Force office of
primary responsibility and adopt the rationale expressed as the basis
for our decision that the applicant has failed to sustain her burden
of having suffered either an error or injustice. She has provided no
evidence validating her contention that her former commanders’ policy
was to not allow members who had applied for resignation to perform
Unit Training Assemblies (UTAs) prior to their transfer to the NNRPS.
Therefore, in the absence of persuasive evidence to the contrary, we
find no compelling basis to recommend granting the relief sought in
this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
