APPLICANT REQUESTS THAT:

He be awarded retirement points  for  the  period  of  31  March  1998
through 30 March 1999.

APPLICANT CONTENDS THAT:

He had received 46 points for the retirement year ending 30 March 1999
and had over 90 points the following year because of having two annual
tours in one year and none in the other.  He  also  contends  that  it
took from November 1998 until 28 February 1999  to  get  him  resigned
from the 911th AW Pittsburgh, PA to 20th CES Shaw AFB, SC.  He  stated
it should only take them 45 to 60 days for reassignment  process.   In
addition, he did not have a break in service.

STATEMENT OF FACTS:

The applicant’s record shows that for retention/retirement (R/R)  year
31 March 1998-30 March 1999, he earned a total of 0 points active duty
(AD) points, 31 inactive  duty  training  (IDT)  points,  0  Extension
Course Institute (ECI) points and 15 membership points for a total  of
46 points, and did not meet the minimum standard of 50  points  for  a
satisfactory year of federal service for retirement.

AIR FORCE EVALUATION:

The Director of Personnel Program Management, ARPC/DPP,  reviewed  the
application and recommended denial because  the  applicant’s  lack  of
participation  which  caused  him  an  unsatisfactory  service   year.
Although the applicant stated that he had applied for reassignment  in
November 1998, he could have participated with his unit of  assignment
until his effective date of transfer on  26 February  1999.   Also  he
could have begun participation with the unit he transferred to  on  27
February 1999, and since his R/R year did not end until 30 March 1999,
that gave him approximately 1 month and another  opportunity  to  earn
the 4 points needed for a satisfactory service year.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

The applicant reviewed the advisory opinion and  stated  that  he  was
unaware of how  the  Retirement/Retention  year  worked.   He  further
stated that he is not asking for points  not  earned.   He  only  want
points transferred from either Inactive Duty performed in August  1999
or Active Duty performed in July and August 1999.

Applicant’s complete response is attached at Exhibit E.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Sufficient relevant evidence has been presented  to  demonstrate
the existence  of  probable  error  or  injustice.   After  thoroughly
reviewing the evidence of record, it appears that  the  applicant  did
not understand that he was allowed to participate with  his  old  unit
until the  effective  date  of  his  reassignment  to  his  new  unit.
Further, he apparently did not realize he could commence participation
with  his  new  unit  once  the  effective   date   was   established.
Considering that the applicant has successfully participated since his
transfer to the Reserves in 1990, with the exception of the  contested
time period, it is unclear why he did not  understand  that  he  could
have participated in these units, as appropriate.  Regardless, we note
that he completed two annual tours  during  retirement/retention  year
ending 30 March 2000 and  has  otherwise  participated  satisfactorily
since his transfer to the Reserves, therefore,  we  believe  that  the
benefit of the doubt should be resolved in his favor.  In view of  the
foregoing, we  recommend  his  records  be  corrected  to  the  extent
indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that he was awarded 4 non-
paid inactive duty  training  (IDT)  points  for  Retention/Retirement
(R/R) year 31 March 1998 to 30 March 1999, resulting in 50  total  and
retirement points and one year of  satisfactory  Federal  service  for
retirement.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that he was awarded
4  non-paid inactive duty training (IDT) points for
Retention/Retirement (R/R) year 31 March 1998 to 30 March 1999,
resulting in 50 total and retirement points and one year of
satisfactory Federal service for retirement.
