APPLICANT REQUESTS THAT:
His DD Form 214 be corrected to reflect award of the Air Force
Commendation Medal (AFCM).

APPLICANT CONTENDS THAT:
The medal was awarded on 25 April 1969. The medal was not issued to
him until a year and half following his discharge.
The applicant submitted with his request a letter dated 5 October
1970, from Sergeant S. (Detachment 22, 30 WSq) forwarding him the
AFCM.
Applicant's complete submission, with attachments, is attached at

STATEMENT OF FACTS:
On 9 August 1965, the applicant enlisted in the Regular Air Force
(RegAF) as an airman basic (AB) for a period of four years.
His records reflect he was awarded the Air Force Good Conduct Medal
(AFGCM) and the National Defense Service Medal (NDSM).
On 14 September 1973, a DD Form 215 was issued to add the Vietnam
Service Medal (VSM) and the Republic of Vietnam Campaign Medal (RVCM)
to the applicant’s DD Form 214.
On 23 May 1969, the applicant was honorably released from active duty
and transferred to the Air Force Reserve. He served 3 years, 9 months
and 15 days of active service.

AIR FORCE EVALUATION:
AFPC/DPPPR states they contacted the applicant on 3 March 2005 and
requested he provide a copy of the special order verifying his
entitlement to the AFCM. On 7 March 2005, the applicant contacted
AFPC/DPPR and informed them he never received a special order when he
received the citation and certificate for the AFCM. AFPC/DPPPR
believes based on the documentation provided the applicant is entitled
to the AFCM but without a special order his entitlement cannot be
verified. Therefore, they recommend his request for award of the AFCM
be denied.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 18 March 2005, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law
or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or an injustice. Although a copy of the order
awarding the applicant the AFCM is unavailable, the applicant has
provided a copy of a letter from his former squadron’s administrative
specialist forwarding him the AFCM. Therefore, we believe, based on
the letter from the administrative specialist, the applicant was
awarded the AFCM for his meritorious service while stationed in the
Republic of Vietnam during the period 3 June 1968 through 3 April
1969. It appears that, through no fault of his own, the award was not
presented to him before he completed his tour. With no basis to
question the veracity of the administrative specialist’s letter, and
in recognition of the applicant’s service to the Nation, it is our
opinion that, based on these facts, any doubt should be resolved in
the applicant's favor. In view of this, we do not believe the absence
of the special order awarding the AFCM should
prevent him from receiving the award. Therefore, we recommend his
records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 25 April 1969, he
was awarded the Air Force Commendation Medal for meritorious service
for the period 3 June 1968 through 3 April 1969.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116) it is directed that:
The pertinent military records of the Department of the
Air Force relating to , be corrected to show that he was
awarded the Air Force Commendation Medal for meritorious service for
the period 3 June 1968 through 3 April 1969.
