APPLICANT REQUESTS THAT:

The misspellings in the 15 Mar 00 and 1 Mar  01  duty  titles  in  the
Assignment History section of the Officer Selection  Brief  (OSB)  for
the Calendar Year  2003A  (CY03A)  Lieutenant  Colonel  (LTC)  Central
Selection Board be  corrected  to  reflect  “Department”  rather  than
“Deptartment” and “Deparment” and he  be  afforded  Special  Selection
Board (SSB) consideration for the CY03A board.

APPLICANT CONTENDS THAT:

He personally made an appointment on or about 15 May 03 to have  these
errors corrected at his servicing  military  personnel  flight  (MPF).
These errors apparently were not  corrected  and  could  lead  to  the
assumption that he is not concerned about his  records  for  promotion
consideration.  He believes this error contributed to his nonselection
to LTC.

STATEMENT OF FACTS:

The applicant is currently serving in the grade of major with  a  date
of rank (DOR) of 1 Mar 00.

He was considered but not selected for  promotion  by  the  CY03A  LTC
board, which convened on 8 Jul 03.  The OSB  originally  prepared  for
that board contained the same spelling errors in  the  1  Mar  00  and
1 Mar 01 duty titles that the applicant is now requesting be changed.

In an application dated 3 Mar 03, the applicant requested he be  given
SSB consideration for the CY03A board with the OSB reflecting  receipt
of the Air Medal (AM) in the Decorations section.  The  applicant  was
not awarded the AM until  28  Aug  03,  after  the  CY03A  aboard  had
convened.  He did not raise the issue of the duty title  misspellings,
but the Data Verification Brief, dated 25 Jun 03,  that  he  submitted
contained these misspellings.  The original CY03A OSB  also  contained
the misspellings.  On 23 Mar 04, the AFBCMR recommended the AM,  which
had been delayed in part  due  to  misplacement,  be  awarded  to  the
applicant at an earlier date so that  it  could  be  included  in  his
selection folder and reflected  on  the  OSB  for  the  CY03A  board’s
consideration.

A copy of the Record of Proceedings (ROP), dated 2  Apr  04,  for  the
applicant’s first appeal is at Exhibit C.

On 24 May 04, the applicant was considered by SSB for the CY03A board,
but was not selected for promotion to LTC.  The OSB included  the  AM,
as well as the misspelled versions of “Department” in the 1 Mar 00 and
1 Mar 01 duty title entries.

The applicant was  considered  but  not  selected  by  the  CY04B  LTC
selection board, which convened on 12  Jul  04.   That  OSB  correctly
spelled “Department” in the two pertinent duty title entries.

AIR FORCE EVALUATION:

HQ AFPC/DPPPO contends there is no clear evidence  the  administrative
errors on his  OSB  negatively  impacted  his  promotion  opportunity.
Promotion board members use the whole person concept  to  assess  such
factors as job performance, professional qualities, leadership,  depth
and  breadth  of  experience,  academic  and   professional   military
education, and specific achievements.  As such, they  do  not  believe
the  administrative  errors  on  the  applicant’s   OSB   caused   his
nonselection.  Therefore denial is recommended.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air  Force  evaluation  was  forwarded  to  the
applicant on 19 Nov 04 for review and comment within 30 days.   As  of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After a thorough  review  of  the
evidence  of  record  and  the  applicant’s  submission,  we  are  not
persuaded he should be afforded SSB consideration for the CY03A board.
 We note he did not raise the issue of the misspellings when he  first
requested, and was granted, SSB consideration for the CY03A board over
the delayed AM.  The administrative errors were  a  matter  of  record
then and when the original  CY03A  board  convened.   Regardless,  the
applicant has not persuaded us these minor errors were responsible for
his nonselection when he was considered by the CY03A board  in  Jul 03
and by the SSB for that board in May 04.   Promotion  boards  consider
the  whole  person,  assessing  such  factors  as   job   performance,
professional qualities, leadership, depth and breadth  of  experience,
academic   and   professional   military   education,   and   specific
achievements.   As  the  applicant  has  not   shown   his   promotion
opportunity was negatively  affected  by  these  essentially  harmless
errors, we agree with the rationale  and  recommendation  of  the  Air
Force.  In view of the above and absent  persuasive  evidence  to  the
contrary, we find no compelling basis on which to  recommend  granting
the relief sought.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
