Lieutenant Colonel Central Selection Board (CSB) with the corrected
Officer Performance Report (OPR) closing 31 May 97.

APPLICANT CONTENDS THAT:
His original 31 May 97 OPR recommended him for Squadron Officer
School (SOS), a level of Professional Military Education (PME) that
he had already completed two years prior. Reports prior to 1997
recommended the appropriate level of Intermediate Service School
(ISS). Two of his raters caught the mistake in 2000 and 2001, but
said it was not repairable.
In support of his application, he provides a copy of the corrected
OPR, and statements from the evaluators supporting correction of
the OPR. The additional rater also supported SSB consideration.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the
grade of major. He has two nonselections to the grade of
lieutenant colonel, by the CY03A (8 Jul 03) (P0503A) and CY04B
(12 Jul 04) (P0504B) Lieutenant Colonel Central Selection Boards
(CSBs).

*On 3 Aug 04, the Evaluation Reports Appeal Board (ERAB) approved
applicant’s request to change the PME recommendation from SOS to
ISS on his 31 May 97 OPR. The ERAB denied his request for SSB,
stating the changes to the OPR were not significant enough to
warrant a review by the SSB.

AIR FORCE EVALUATION:
HQ AFPC/DPPPO reviewed this application and recommended denial.
They stated, in part, there is no clear evidence that the incorrect
PME recommendation on applicant’s OPR negatively impacted his
promotion opportunity. Central Boards evaluate the entire officer
selection record assessing whole person factors such as job
performance, professional qualities, depth and breadth of
experience, leadership, and academic and professional military
education. The selection board had his entire selection record
that clearly outlined his accomplishments since the date he came on
active duty. They are not convinced the administrative error on
the applicant’s OPR caused his nonselection for promotion.
Additionally, although the PME recommendation on the applicant’s
31 May 97 OPR was incorrect, his PME recommendation for “ISS” was
correctly reflected on his OPRs closing 15 Dec 95 and 31 May 96,
and his completion of SOS in 1995 was reflected on his P0503A
Officer Selection Brief (OSB). As such, we believe the board
members were able to distinguish between the incorrect PME
recommendation on the contested OPR and the correct data on his
previous OPRs and P0503A OSB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 29 Oct 04, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After thoroughly reviewing
the complete case file, we are persuaded that some doubt exists as
to the accuracy of the applicant’s records when he was considered
for promotion by the CY03A and CY04B Lieutenant Colonel Central
Selection Boards. In this respect, we note that subsequent to
these Boards, the OPR closing 31 May 97, was corrected to reflect a
PME recommendation for ISS rather than SOS. While it is not
certain what impact the incorrect PME recommendation may have had
on his chances for promotion to the grade of lieutenant colonel, we
believe any doubt should be resolved in his favor. In view of the
foregoing and in an effort to remove any possibility of an
injustice to the applicant, we recommend that his record, to
include the corrected OPR, be considered for promotion to the grade
of lieutenant colonel by Special Selection Board (SSB) beginning
with the CY03A Selection Board.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, to include the corrected Company Grade
Officer Performance Report (OPR), AF Form 707B, rendered for the
period 1 June 1996 through 31 May 1997, be considered for promotion
to the grade of lieutenant colonel by Special Selection Board
beginning with the Calendar Year 2003A Lieutenant Colonel Central
Selection Board and any subsequent boards for which the corrected
OPR was a matter of record.

authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, to include the attached corrected
Company Grade Officer Performance Report (OPR), AF Form 707B,
rendered for the period 1 June 1996 through 31 May 1997, be
considered for promotion to the grade of lieutenant colonel by
Special Selection Board beginning with the Calendar Year 2003A
Lieutenant Colonel Central Selection Board and any subsequent
boards for which the corrected OPR was a matter of record.
