RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2004-01396
INDEX CODE:
COUNSEL: NONE
HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS THAT:
He be considered for promotion to the grade of lieutenant colonel by
Special Selection Board (SSB) for the Calendar Year 2002B Lieutenant
Colonel Central Selection Board (CBS) in-the-promotion zone (IPZ),
with inclusion of a corrected Officer Selection Brief (OSB).
_________________________________________________________________
APPLICANT CONTENDS THAT:
He was assigned to the Defense Information Systems Agency as of 10
October 2002.
In support of the appeal, applicant submits a copy of his OSB.
Applicant's complete submission, with attachment, is at Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the
grade of major.
Applicant was nonselected IPZ to the grade of lieutenant colonel by
the CY02B board. Subsequently, he was considered by an SSB on 22
September 2003 with inclusion of his 3 July 2002 OPR and was
nonselected for promotion. However, he was selected to lieutenant
colonel above-the-promotion zone (APZ) by the CY03A CSB and promoted
to the grade of lieutenant colonel on 1 May 2004.
Applicant’s Officer Performance Reports (OPRs) from 1991 through 2003
reflect meets standards on all performance factors.

AIR FORCE EVALUATION:
AFPC/DPASC states applicant has served in a joint duty position at the
Defense Information Systems Agency from 7 October 2002 until present.
If not already corrected, the Joint Duty History on his Officer
Selection Brief should be corrected from “Defense Intelligence Agency”
to “Defense Information Systems Agency.”
A complete copy of the evaluation is attached at Exhibit C.
AFPC/DPPPO states eligible officers meeting CSBs are given Officer
Preselection Briefs (OPBs) 90-100 days prior to the board. The OPB
contains data that will appear on the OSB for the board’s
consideration. Since the applicant’s joint duty assignment became
effective after he received his OPB, the data was not reflected on
this document. However, it was the applicant’s responsibility to
ensure this data was correctly updated on his OSB. Furthermore, the
instructions attached to the OPB tell the officers to carefully
examine their record for completeness and accuracy, and that they may
correspond by letter to the board to call attention to any matter of
record concerning them that they believe important to their
consideration. The applicant did not exercise his option to write to
the board informing them of the data change nor did he provide any
documentation demonstrating that he exercised due diligence in
ensuring his OSB was correct prior to convening of the board.
The AFPC/DPASC advisory confirms the organization for the Joint Duty
History data should reflect Defense Information Systems Agency instead
of Defense Intelligence Agency. However, they conclude that this
error was entirely administrative and trust that the promotion board
members used the whole person concept to assess such factors as job
performance, professional qualities, leadership, depth and breadth of
experience, and academic and professional military education, in
addition to specific achievements reflected in his OSR to render their
original promotion recommendation. Their reasoning is also based on
the fact that the OSB reviewed by the CY03A CSB had the same Joint
Duty History error, yet he was selected for promotion to lieutenant
colonel by that board. Therefore, they recommend denial of
applicant’s request.
A complete copy of the evaluation, with attachments, is attached at
Exhibit D.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 30 July 2004, a copy of the Air Force evaluation was forwarded to
the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. We took notice of the
applicant’s complete submission in judging the merits of this case;
however, we agree with the opinion and recommendation of the Air Force
and adopts their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice.
Therefore, in the absence of evidence to the contrary, we find no
compelling basis to recommend granting the relief sought in this
application.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

However, the applicant provided a Military Personnel Flight (MPF) certified copy of the same OPR with a correction to the close out date reflecting 2 June 2003. Regardless, either report (with a close out date of 2 June 2003 or 2 July 2003) was not required to be on file for the P0503A CSB. After reviewing the evidence of record, we note the applicant’s OSB did not reflect his current duty assignment at the time the board convened; however, evidence supports that his PRF, reviewed by the...

A complete copy of the evaluation, with attachment, is attached at Exhibit C. AFPC/DPPPO states that each officer eligible for a CSB receives an Officer Preselection Brief (OPB) prior to convening of the board which contains the same data that will appear on the OSB at the central board. The instructions specifically state, “Officers will not be considered by a Special Selection Board if, in exercising reasonable diligence, the officer should have discovered the error or omission in his/her...

The applicant failed to exercise reasonable diligence in maintaining his record prior to the CSBs; therefore, that office recommends denial of the applicant’s request for SSB consideration with the corrected DAFSC. Applicant’s Officer Selection Brief (OSB) and Officer Performance Report (OPR) for the period 22 May 1992 to 10 May 1993, did not reflect his correct Duty Air Force Specialty Code S1555E at the time he was considered for promotion by the CY00A, CY01B, CY02B and the CY03A...

His senior rater at the time was responsible for providing promotion recommendations to the selection board. Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice warranting correction to the applicant’s Officer Selection Brief (OSB) and Officer Selection Record (OSR) and Special Selection Board (SSB) consideration for promotion to the grade of lieutenant colonel. It is further recommended that the applicant’s corrected record be considered for...

The signature date of 28 July 2003 on his AF Form 475 (Education/Training Report), closing 28 March 2003, be changed to an earlier date so that it may be accepted for filing for the CY03A (8 July 2003) (P0503A) Lieutenant Colonel Central Selection Board (CSB). He was wronged by the excessive period of time it took to complete and file his final Training Report (TR) in his Officer Selection Record (OSR); as well as the time it took to update his current duty history after he arrived at the...
