APPLICANT REQUESTS THAT:

He be considered for promotion to the grade of lieutenant  colonel  by
Special Selection Board (SSB) for the Calendar Year  2002B  Lieutenant
Colonel Central Selection Board  (CBS)  in-the-promotion  zone  (IPZ),
with inclusion of a corrected Officer Selection Brief (OSB).

APPLICANT CONTENDS THAT:

He was assigned to the Defense Information Systems  Agency  as  of  10
October 2002.

In support of the appeal, applicant submits a copy of his OSB.

Applicant's complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

The applicant is currently serving on  extended  active  duty  in  the
grade of major.

Applicant was nonselected IPZ to the grade of  lieutenant  colonel  by
the CY02B board.  Subsequently, he was considered  by  an  SSB  on  22
September 2003  with  inclusion  of  his  3  July  2002  OPR  and  was
nonselected for promotion.  However, he  was  selected  to  lieutenant
colonel above-the-promotion zone (APZ) by the CY03A CSB  and  promoted
to the grade of lieutenant colonel on 1 May 2004.

Applicant’s Officer Performance Reports (OPRs) from 1991 through  2003
reflect meets standards on all performance factors.

AIR FORCE EVALUATION:

AFPC/DPASC states applicant has served in a joint duty position at the
Defense Information Systems Agency from 7 October 2002 until  present.
If not already corrected,  the  Joint  Duty  History  on  his  Officer
Selection Brief should be corrected from “Defense Intelligence Agency”
to “Defense Information Systems Agency.”

A complete copy of the evaluation is attached at Exhibit C.

AFPC/DPPPO states eligible officers meeting  CSBs  are  given  Officer
Preselection Briefs (OPBs) 90-100 days prior to the  board.   The  OPB
contains  data  that  will  appear  on  the  OSB   for   the   board’s
consideration.  Since the applicant’s  joint  duty  assignment  became
effective after he received his OPB, the data  was  not  reflected  on
this document.  However, it  was  the  applicant’s  responsibility  to
ensure this data was correctly updated on his OSB.   Furthermore,  the
instructions attached to  the  OPB  tell  the  officers  to  carefully
examine their record for completeness and accuracy, and that they  may
correspond by letter to the board to call attention to any  matter  of
record  concerning  them  that  they  believe   important   to   their
consideration.  The applicant did not exercise his option to write  to
the board informing them of the data change nor  did  he  provide  any
documentation  demonstrating  that  he  exercised  due  diligence   in
ensuring his OSB was correct prior to convening of the board.

The AFPC/DPASC advisory confirms the organization for the  Joint  Duty
History data should reflect Defense Information Systems Agency instead
of Defense Intelligence Agency.   However,  they  conclude  that  this
error was entirely administrative and trust that the  promotion  board
members used the whole person concept to assess such  factors  as  job
performance, professional qualities, leadership, depth and breadth  of
experience, and  academic  and  professional  military  education,  in
addition to specific achievements reflected in his OSR to render their
original promotion recommendation.  Their reasoning is also  based  on
the fact that the OSB reviewed by the CY03A CSB  had  the  same  Joint
Duty History error, yet he was selected for  promotion  to  lieutenant
colonel  by  that  board.   Therefore,  they   recommend   denial   of
applicant’s request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 30 July 2004, a copy of the Air Force evaluation was  forwarded  to
the applicant for review and response within  30  days.   As  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant’s complete submission in judging the merits  of  this  case;
however, we agree with the opinion and recommendation of the Air Force
and adopts their rationale as the basis for the  conclusion  that  the
applicant  has  not  been  the  victim  of  an  error  or   injustice.
Therefore, in the absence of evidence to  the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
