APPLICANT REQUESTS THAT:
1. He be considered for promotion to the grade of lieutenant colonel
by Special Selection Board (SSB) for the Calendar Year 2002B
Lieutenant Colonel Central Selection Board (CSB), with inclusion of
the Air Force Achievement Medal (AFAM), First Oak Leaf Cluster (1OLC)
in his records.
2. He be considered for promotion to the grade of lieutenant colonel
by Special Selection Board (SSB) for the Calendar Year 2003A
Lieutenant Colonel Central Selection Board (CSB), with inclusion of
the Air Force Achievement Medal (AFAM), Second Oak Leaf Cluster (2OLC)
in his records.

APPLICANT CONTENDS THAT:
Per a phone conversation with an individual from the Air Force
Personnel Center records section prior to the CY02B Lieutenant Colonel
Board meeting, he was informed his personnel records were 100%
complete. During his records review on 7 March 2003, he was informed
the AF Achievement Medal (1OLC) was listed in his records but
physically missing. This citation was physically present in his duty
station records. He feels the board did not evaluate a complete
picture of his records.
At the time the CY03A Lieutenant Colonel Board convened, he was
unaware he had been awarded an AF Achievement Medal (2 OLC-RDP 18 June
2003). The medal was presented to him on or about 30 July 2003 at his
new duty station. An Officer SURF (Current as of 6 October 2003)
still does not indicate the decoration. He completed/graduated from
Joint Forces Staff College (JPME Phase II) on 27 June 2003. A copy of
the Training Report did not make it into his records prior to the
Board convening. The PME information section of the Officer SURF
(Current as of 6 October 2003) still does not indicate his completion
of JPME Phase II. He feels the board was unable to evaluate a
complete picture of his records and he requests Special Selection
Board consideration.
In support of the appeal, applicant submits a copy of the missing AFAM
(1OLC and 2OLC), a copy of a SURF dated 20 August 2002 displaying
records are current as of 12 August 2002, a copy of an e-mail
conversation discussing his situation, a copy of the National Defense
University/Joint Forces Staff College/Joint PME Phase II certificate,
a copy of his AF Form 475 from JPME Phase II, and a copy of three
SURFs (30 June 2003, 7 July 2003 and 6 October 2003).

STATEMENT OF FACTS:
The applicant is a Regular Air Force officer serving in the grade of
major.
Applicant was considered and not selected for promotion to the grade
of lieutenant colonel by the CY02B and CY03A Lieutenant Colonel
Central Selection Board. His current date of separation is 31 July
2007.

On 28 January 2004, AFPC/DPPPOC notified the applicant that his
request for Special Selection Board (SSB) consideration by the CY02B
Lieutenant Colonel Central Selection Board (CSB) with the inclusion of
the Air Force Achievement Medal (AFAM), First Oak Leaf Cluster,
citation filed in his officer selection record was being granted.

AIR FORCE EVALUATION:
AFPC/DPPPO states that because the order for the AFAM, 2OLC, inclusive
dates 1 February 2003 - 11 February 2003, was published on 14 July
2003, the citation was not included in his selection record nor was it
reflected in any of their official personnel data systems at the time
the CY03A board convened. For the purpose of including this
decoration in a board that convened on 8 July 2003, the decoration did
not exist.
When applying the filing disposition rules set forth in AFI 36-2406,
the training report that closed out 27 June 2003, was not missing from
the applicant’s selection folder because it was not mandatory to be
filed in his records any earlier than 60 days following the close out
date of the report. Therefore, the record was complete and accurate
when it was reviewed by the board. Therefore, they recommend denial
of applicant’s request.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 6 February 2004, a copy of the Air Force evaluation was forwarded
to the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the evidence of
record, we are not persuaded that the applicant’s records are in error
or that he has been the victim of an injustice. His contentions are
noted; however, in our opinion, the detailed comments provided by the
appropriate Air Force offices adequately address those allegations.
Therefore, we agree with opinions and recommendations of the Air Force
and adopt their rationale as the basis for the conclusion that the
applicant has not been the victim of an error or injustice. In the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.
