APPLICANT REQUESTS THAT:
His records be corrected to reflect that he enlisted in the Regular Air
Force in the grade of E-2.

APPLICANT CONTENDS THAT:
His grade of E-2 was removed when he changed services from the Marine Corps
to the Air Force. The Board for Correction of Naval Records (BCNR) has
corrected his records to reflect that he was promoted to E-2, effective 1
Feb 74.
In support of his request, applicant provided a personal statement, a
photo, a training certificate, correspondence from the Air Force Personnel
Center, documentation associated with his BCNR application, and various
documents extracted from his military records. His complete submission,
with attachments, is at Exhibit A.

STATEMENT OF FACTS:
Applicant served in the United States Marine Corps Reserve from 27 Jul 73
through 6 Oct 76. During that period he served 5 months and 22 days on
active duty for training. He was discharged from the Marine Corps Reserve
in the grade of E-1. On 7 Oct 76 he enlisted in the Regular Air Force in
the grade of E-1. He was progressively promoted to the grade of E-2 on 7
Apr 76 and to E-3 on 7 Oct 77. On 13 Jun 79, after receiving nonjudicial
punishment under Article 15 for possession of marijuana, he was reduced to
the grade of E-2. He was subsequently promoted to E-3 on 13 Dec 79. He
was voluntarily separated from the Air Force on 10 Oct 80. He served four
years and three days on active duty in the Air Force. The period 25 Sep 78
through 28 Sep 78, is considered time lost.
On 15 May 03, the BCNR corrected his records to reflect that he was
promoted to the grade of E-2 effective 1 Feb 74.

AIR FORCE EVALUATION:
AFPC/DPPPWB recommends denial. DPPPWB states that the applicant's service
dates have been reviewed and it was determined that his rank, date of rank,
and Total Active Military Service Date were computed correctly. The DPPPWB
evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 5 Mar
04 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice that would warrant corrective action. The
applicant enlisted in the Regular Air Force on 7 Oct 76 in the grade of
airman (E-1). His enlistment grade was determined based on the fact that
his Marine Corps discharge documents reflect that he was separated in the
grade of E-1. However, the Board for Correction of Naval Records
determined that his grade held at separation was in error and directed that
his discharge documents be corrected to reflect that he was separated in
the grade of E-2. As such, it is our opinion that his records should be
corrected to reflect that he enlisted on 7 Oct 76 in the grade of airman,
that he was progressively promoted to the subsequent grades of airman first
class on 7 Apr 77 and to sergeant on 1 Feb 79. Since the correction to his
records will result in his promotion to sergeant prior to his nonjudicial
punishment action, we believe it is appropriate to correct his punishment
to reflect that he was reduced from the grade of sergeant to the grade of
airman first class, rather than from the grade of airman first class to the
grade of airman. Since the applicant separated on 10 Oct 80, and would not
have met the requirements for promotion to sergeant prior to his
separation, it is our opinion that his grade at separation should remain as
airman first class. Accordingly, we recommend his records be corrected as
indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that:
a. On 7 October 1976, he enlisted in the Regular Air Force in the grade of
airman, rather than airman basic.
b. He was promoted to the grade of airman first class on 7 April 1977,
rather than 7 October 1977.
c. He was promoted to the grade of sergeant effective and with a date of
rank of 1 February 1979.
d. On 13 Jun 79, he was reduced from the grade of sergeant to the grade of
airman first class, rather than from the grade of airman first class to the
grade of airman.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to , be corrected to show that:
a. On 7 October 1976, he enlisted in the Regular Air Force in
the grade of airman, rather than airman basic.
b. He was promoted to the grade of airman first class on 7
April 1977, rather than 7 October 1977.
c. He was promoted to the grade of sergeant effective and with
a date of rank of 1 February 1979.
d. On 13 Jun 79, he was reduced from the grade of sergeant to
the grade of airman first class, rather than from the grade of airman first

During that period there was no performance report, no credit for time in grade and no active duty assignment. On 1 Feb 79, he reenlisted in the Regular Air Force. The applicant contends that by making an exception to policy when he reenlisted in 1979, the Air Force "acknowledged there was no appropriate applicability" of the regulation that barred him from reenlistment in 1978.
