APPLICANT REQUESTS THAT:

In the applicant’s  request  for  reconsideration,  she  requests  that  her
Promotion Recommendation Form (PRF) be amended  to  reflect  a  Professional
Military Education (PME)  recommendation  for  Intermediate  Service  School
(ISS) and that she be considered for promotion to the grade of  major  by  a
Special Selection Board (SSB).

STATEMENT OF FACTS:

Information extracted from the Personnel Data  System  (PDS)  indicates  the
applicant’s Total Active Federal  Military  Service  Date  as  30  September
1991.  She is currently serving on active duty  in  the  grade  of  captain,
with a date of rank of 20 July 1995.  The applicant has  five  nonselections
to the grade of major.

On 3 June 2003, the applicant’s request that her PRF be amended  to  reflect
a PME recommendation for ISS and that she be  considered  for  promotion  to
the grade of major by an SSB was considered and denied by  the  Board.   For
an accounting  of  the  facts  and  circumstances  surrounding  the  Board’s
consideration of the appeal, see the Record of Proceedings at Exhibit F.

On 25 March 2004, the applicant submitted  a  request  for  reconsideration,
contending that the chain-of-command failed to adequately do  their  job  in
accordance with Air Force instructions and did not understand the  promotion
process.  In addition, based  on  her  colleague’s  statement,  her  marital
status determined her promotion potential.  The  applicant’s  submission  is
at Exhibit G.

THE BOARD CONCLUDES THAT:

In earlier findings,  the  Board  determined  that  there  was  insufficient
evidence to warrant approval of the applicant’s  request  that  her  PRF  be
amended to reflect a PME recommendation for ISS and that she  be  considered
for  promotion  to  the  grade  of  major  by  an   SSB.     After   careful
reconsideration of her request we do not find it sufficiently compelling  to
warrant a revision of  the  Board’s  earlier  determination  in  this  case.
Based on her colleague’s personal observation, the applicant  believes  that
her marital status was a factor  in  determining  her  promotion  potential.
There is nothing in the evidence provided which would  lead  us  to  believe
that this is the case.  More importantly, there is no  indication  that  the
applicant ever filed an Equal  Opportunity  Treatment  complaint  concerning
this alleged discrimination, as was her right to do.  Based on the  evidence
of record, we can discern no indication that the  senior  rater  abused  his
discretionary authority or that his comments  were  based  on  inappropriate
considerations.  Therefore, in the absence of  persuasive  evidence  to  the
contrary, we find no compelling basis to recommend  granting  relief  sought
in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of probable material error or injustice; that the  application
was denied without a personal appearance;  and  that  the  application  will
only be reconsidered  upon  the  submission  of  newly  discovered  relevant
evidence not considered with this application.
