APPLICANT REQUESTS THAT:

His records be corrected to show he was awarded the Small Arms  Expert
Marksmanship Ribbon (SAEMR).

APPLICANT CONTENDS THAT:

He is entitled to the Small Arms Expert Marksmanship Ribbon, which  he
earned while at Lackland Air Force Base.

In support of his request, the applicant submits a copy of his DD Form
214, Certificate of Release or Discharge from Active Duty.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant served on active duty from 17 August  1965  to  7 August
1969.  He was released  from  active  duty  and  issued  an  honorable
discharge after completing his term  of  service.   His  DD  Form  214
reflects award of the National Defense  Service  Medal,  and  the  Air
Force Good Conduct Medal.  He served 3 years, 11 months and 21 days of
active duty service.

AIR FORCE EVALUATION:

The AFPC/DPPPR recommends denial.  The applicant did not  provide  any
documentation showing that he qualified as  Expert  on  an  Air  Force
firing range.  Without any documentation to  substantiate  his  claim,
they are unable to verify applicant's entitlement to the SAEMR.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 3
Oct 03, for review and comment within 30 days.  As of this date,  this
office has received no response.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of  an  error  or  injustice.   The  applicant  has  not
submitted nor does his military records have documentation  to  verify
his eligibility for  award  of  the  Small  Arms  Expert  Marksmanship
Ribbon.  We agree with the opinion and recommendation of the Air Force
office of primary responsibility and  adopt  their  rationale  as  the
basis for our conclusion that the applicant has not been the victim of
an error or injustice.  Therefore, in the absence of evidence  to  the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of a material error or injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
