APPLICANT REQUESTS THAT:

His records be corrected to reflect his grade as a senior airman (E-4)
with the effective date of rank of 4 March 1997  and  pay  date  of  4
March 1994.

APPLICANT CONTENDS THAT:

The Military Personnel Data System (MilPDS) is showing 27 July 1994 as
his pay date and 9 November  2001  as  his  date  of  rank,  which  is
incorrect.  His DD Form 214 reflects his date entered active duty as 4
March 1994 and his date of rank as 4 March 1997.

In support of his request, the applicant submits a copy of his DD Form
214.  The applicant’s complete  submission,  with  attachment,  is  at
Exhibit A.

STATEMENT OF FACTS:

The applicant contracted his initial enlistment  in  the  Regular  Air
Force on 4 March 1994 in the grade of airman basic (E-1) for a  period
of four years.  He was progressively promoted to the grade  of  senior
airman (E-4), with an effective date and date of rank of 4 March 1997.
 The applicant was released from active duty and  transferred  to  the
Air Force Reserve in the grade of senior airman (E-4) on 3 March  1998
under the provisions of AFI 36-3208  (completion  of  required  active
service).  At the time of applicant’s separation from active duty on 3
March 1998, the effective date of his pay grade was 4 March 1997.   On
4 March 1998, the applicant enlisted in the Reserve of the  Air  Force
and was honorably discharged from the Air Force Reserve on 15 December
2001 for completion of service.  Applicant had a break-in-service from
15 December 2001 to 9 May 2002, when he enlistment in the Regular  Air
Force in the grade of E-4 for a period of six years.

Information extracted from MilPDS reveals the applicant’s E-4 Date  of
Rank (DOR) as 9 November 2001 and his pay date as 27 July 1994.

AIR FORCE EVALUATION:

HQ AFPC/DPPAOR recommends the application be  denied.   DPPAOR  states
that, upon entry to active duty, a Date of Rank (DOR) computation  was
created in accordance with AFI 36-2604 and his pay date  was  adjusted
in accordance with  DoDFMR  7000,  14-R,  Volume  7A.   Based  on  the
governing directives, the applicant’s DOR and pay date  were  computed
correctly.  However, if the decision is to grant  the  relief  sought,
the record should be corrected to show applicant’s DOR as 4 March 1997
and his pay  date  changed  to  4  March  1994.   The  HQ  AFPC/DPPAOR
evaluation, with attachments, is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  applicant  on  30
May 2003 for review and response.  As of this date,  no  response  has
been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case.
However, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and adopt the rationale expressed  as
the basis for our decision that the applicant has  failed  to  sustain
his burden that he has suffered either an error or an  injustice.   In
view of the above and absent evidence to  the  contrary,  we  find  no
compelling basis to recommend  granting  the  relief  sought  in  this
application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
