APPLICANT REQUESTS THAT:
His enlistment grade of E-3 be changed to E-5, since he held the grade
of E-5 in the Air National Guard.

STATEMENT OF FACTS:
On 26 October 2001, the AFBCMR considered and denied the applicant’s
above request (Exhibit F).

AIR FORCE EVALUATION:
HQ USAF/DPL recommends that the applicant’s date of rank (DOR) as a
staff sergeant be adjusted to the date he entered active duty and that
he be paid all backpay and allowances. They were advised by the Office
of the Air Force General Counsel that they have the authority to waive
grade and date of rank time-in-service. The applicant’s case was never
presented to their office for consideration. They believe that if the
applicant’s case had been presented to their office prior to the
applicant entering active duty, a favorable decision would have been
made on his behalf.

THE BOARD CONCLUDES THAT:
Sufficient relevant evidence has been presented to demonstrate the
existence of probable error or injustice. The Board accepts the
determination and recommendation of HQ USAF/DPL that the
applicant’s case be approved. Therefore, the Board recommends that
the applicant’s records be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that he enlisted in the
Regular Air Force beginning in the pay grade of staff sergeant (E-
5) rather than airman first class (E-3), effective and with a date
of rank of 10 June 1999.

Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the
authority of Section 1552, Title 10, United States Code (70A Stat
116), it is directed that:
The pertinent military records of the Department of the Air
Force relating to XXXXXXXXXX, XXX-XX-XXXX, be corrected to show
that he enlisted in the Regular Air Force beginning in the pay
grade of staff sergeant (E-5) rather than airman first class (E-3),
effective and with a date of rank of 10 June 1999.

As an alternative, if the Board determines that the applicant has suffered an injustice, it could consider directing supplemental consideration using the applicant’s PFE score from the next cycle, 02E7 (testing 15 Feb -31 Mar 02), and applying it retroactively to the 01E7 cycle.
