APPLICANT REQUESTS THAT:
His under other than honorable conditions (UOTHC) discharge be
upgraded to general (under honorable conditions).

APPLICANT CONTENDS THAT:
The discharge he received was not what he was told he would get. He
never bothered to change it because it never has bothered him until
now. He has an outstanding record at the U.S. Postal Service for 43
years. He was given credit for military time until he was retired.
Also USPS says that they have no record of his military time. They
said it was burned in St Louis.
In support of his application, he submits a copy of his DD Form 214.

STATEMENT OF FACTS:
Applicant's military personnel records were destroyed by fire in 1973.
Therefore, the facts surrounding his separation from military service
cannot be verified.
The only available documentation indicates that the applicant enlisted
in the Regular Air Force as an airman basic on 7 September
1956. The applicant was involuntarily discharged under the provision
of AFR 39-17 (unfitness) with service characterized as under other
than honorable conditions (UOTHC) on 19 August 1958 in the grade of
airman basic. He served 1 year, 10 months and 18 days of total active
military service.

AIR FORCE EVALUATION:
AFPC/DPPRS deferred to the Board to determine if the applicant should
be granted relief based on limited supporting documentation in his
record.
AFPC/DPPRS complete evaluation is attached at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
25 July 2003, for review and comment within 30 days. As of this date,
no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to demonstrate
the existence of an error or injustice. Based upon the presumption of
regularity in the conduct of governmental affairs and without evidence
to the contrary, we must assume that the applicant's discharge was
proper and in compliance with appropriate directives. The only other
basis upon which to upgrade his discharge would be based on clemency.
However, the applicant failed to provide documentation pertaining to
his post-service activities. Should he provide documentary evidence
pertaining to his post-service record, we would be willing to
reconsider his appeal. In the absence of such evidence, favorable
action is not recommended.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of a material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

On 18 December 1987, the Air Force Discharge Review Board (AFDRB) approved applicant's request for upgrade of his discharge to honorable; however, his request for a change of RE code was denied.
