APPLICANT REQUESTS THAT:

The starting date of his service commitment be changed.

APPLICANT CONTENDS THAT:

While he incurred a six-year service commitment to the Air  Force  (he
elected to fulfill the commitment in the Air National Guard (ANG), his
service commitment date should be the date of his  commissioning  (May
1997) and not the date he began service with the ANG: February 1998.

In support of his appeal, he has  provided  a  significant  amount  of
supporting material.  His submission, with attachments, is at  Exhibit
A.

STATEMENT OF FACTS:

The applicant attended college under an ROTC scholarship and graduated
in May 1997.  The applicant incurred an 8-year service commitment as a
result of the scholarship wherein he agreed to  the  Military  Service
Obligation (MSO) by signing AF Form 1056.

On 16 May 1997, applicant was appointed as a Reserve of the Air  Force
in the grade of 2nd Lieutenant and assigned to the  Obligated  Reserve
Section (ORS) of the Ready Reserve to begin fulfilling his 8-year  MSO
(which would be fulfilled in May 2005).  On 9 June 1997, the applicant
applied for reassignment to the Tennessee Air National Guard (TN ANG).
 His application was approved on 13 June 1997 and on 9 December  1997,
applicant signed an ANG service  agreement  for  a  4-year  commitment
beginning on his date of appointment.  On 16 January  1998,  applicant
was approved, by HQ ANG/MPPSO, for appointment in the TN ANG as a  2nd
Lieutenant.  On 28 February 1998, Special Order AB  70  was  published
wherein the applicant began fulfilling his 4-year obligation to the TN
ANG which would expire in February 2002.

AIR FORCE EVALUATION:

ARPC/DPA recommends denial.  DPA notes that the applicant incurred  an
8-year service obligation (not 6 years as the applicant states in  his
letter) that he began to fulfill on     16  May  1997.   Consequently,
his MSO is 15 May 2005.

DPA notes that the applicant was released from a  4-year  active  duty
obligation with the Air Force to serve in the ANG as evidenced by  the
AF Form 1288 indorsed by Air Force Personnel Center (AFPC) on 13  June
1997.  DPA notes also that the applicant  incurred  a  4-year  service
obligation with the ANG effective     28 February 1998 that  made  his
MSO for the ANG 27 February 2002, which he has fulfilled.

Notwithstanding the fact that the ANG obligation  has  been  met,  the
applicant still has until 15 May 2005 to fulfill his original  service
obligation to the Air Force.

DPA addresses the applicant’s concerns about the EDCSA date by stating
that the EDCSA has  nothing  to  do  with  applicant’s  MSO  but  only
signifies the effective date of assignment to the ANG.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 7
March 2003 for review and comment within 30 days.  As of this date, no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and recommendation of the Air Force
office of primary responsibility and  adopt  their  rationale  as  the
basis for our conclusion that the applicant has not been the victim of
an error or injustice.  The record seems  imminently  clear  that  the
applicant incurred a military service obligation date of 15  May  2005
irrespective of any other dates listed in his records.  Therefore,  in
the absence of evidence to the contrary, we find no  compelling  basis
to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
