APPLICANT REQUESTS THAT:

His records, to include a corrected Officer’s Selection  Brief  (OSB),
receive Special Selection Board (SSB) consideration for  promotion  to
the grade of major for the Calendar Year  2002A  and  2002B  Selection
Boards.

APPLICANT CONTENDS THAT:

His record was incorrect for his primary major’s board and  his  first
above the zone board.  He requested the removal of an  incorrect  duty
history entry five times over a period of two years.   This  incorrect
duty history listed him as being  assigned  to  ----  Area  Audit,  at
Hickam AFB HI.  He did a  pre-board  records  review  and  once  again
attempted to correct his record.  Only after the post-board review  of
his records, was he able to get this corrected. During the  post-board
records review, he was told this incorrect duty history had a negative
effect on his promotion board.  After printing a current SURF to  show
that this was corrected, he discovered another incorrect duty  history
listed.  He cannot be sure if this mistake was  on  his  records  that
went to the current board, but it is an example of what  he  has  been
fighting for two years.  It shows a  double  entry  for  him  at  Cape
Canaveral AFS as a K13S3B.  These errors reflect  negatively  on  him,
and place a question of why they were there  and  why  they  were  not
corrected before the board met.  There are so many qualified  officers
meeting the board, it only takes one small error to negatively  affect
his records and chances for promotion.

In support of his  appeal,  the  applicant  submitted  copies  of  his
Officer Selection Briefs, OPRs, assignment  notification,  letters  of
request for correction of records, and letters  of  support  from  co-
workers.

STATEMENT OF FACTS:

The applicant is currently serving on  extended  active  duty  in  the
grade of captain.

Applicant was considered and not selected for promotion to  the  grade
of major by the 2002A and 2002B Central Major Selection Boards.

Applicant’s OPR profile since 1997 indicates "Meets Standards."

AIR FORCE EVALUATION:

AFPC/DPAO stated that all requested changes by the applicant have been
made.   They  defer  to  AFPC/DPPPO  for   Special   Selection   Board
recommendation

AFPC/DPAO complete evaluation is at Exhibit C.

AFPC/DPPPO recommended denial and states that  each  officer  eligible
for promotion consideration by the CY02A board was provided an officer
preselection brief  90-100  days  prior  to  the  board  convening  in
February 2002.  Written  instructions  attached  to  the  preselection
brief explained  the  opportunity  of  communicating  with  the  board
president by writing a letter.  Although the  applicant  attempted  to
correct the duty history error prior to the board, to no avail, if  he
believed the error to be relevant to the promotion process,  he  could
have provided this information by letter  to  the  board.   They  have
verified the applicant elected not to exercise this entitlement.

Additionally, although the duty history was incorrect on his OSB,  the
correct data was reflected on his  corresponding  officer  performance
reports  (OPRs).   As  such,  they  believe  the  board  was  able  to
distinguish the difference between the information on the OSB, and the
information reflected on his OPRs.

There is no  clear  evidence  that  the  incorrect  duty  title  entry
negatively  impacted  his  promotion  opportunity.    Central   boards
evaluate the entire officer selection record (including the  promotion
recommendation form, OPRs, officer effectiveness reports, and training
reports, letters of evaluation, decorations, and OSB), assessing whole
person factors such as job performance, professional qualities,  depth
and breadth of experience, leadership, and academic  and  professional
military  education.   Therefore,   they   are   not   convinced   the
administrative  error  on  his  OSB  contributed  to  the  applicant’s
nonselection.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Applicant reviewed the Air Force evaluations and stated that even with
this application, he cannot get the  right  information  listed.   The
fact that they are calling his request for this action  a  duty  title
error versus duty history is another example of the  problems  he  has
faced.  He has diligently tried to keep his records  correct  and  has
had to fight to get them corrected numerous times.  To say  that  this
error had no negative effect on the board does  not  account  for  how
competitive these boards are and how the smallest thing can  mean  the
difference between promotion and not being  promoted.   All  of  these
factors have affected his promotion opportunity and  he  request  that
his records have the opportunity to face the board  with  the  correct
information.

The applicant has provided additional information and stated  that  he
has requested an SSB to review his records for promotion because of an
incorrect duty history entry that was listed on his records.   He  has
attempted to change this error numerous times and thought it was fixed
prior to  his  first  promotion  board  (CY02A).   Unfortunately,  the
problems with MILMOD and other personnel systems did  not  update  his
records prior to the first board.  This is his second  letter  to  you
about the numerous errors and mistakes he has had to deal with on  his
records.  Mistakes that he continue to find and correct as of today.

This week he had to make two more corrections  to  his  duty  history,
when he discovered the dates were wrong and his current  position  was
not listed.  Somehow, it had been changed.   He  has  fixed  the  duty
history error in MILMOD/PCC and it is current as of  today.   He  also
discovered that his PRF for CY02A, PRF for CY02B, and his current  OPR
had the incorrect duty title listed.  It is three weeks from his  next
promotion board and he  has  started  the  process  to  correct  these
mistakes.  However, for the CY02B board, his duty title was  incorrect
on his PRF that met the board.  He  cannot  tell  the  Board  if  this
affected the outcome of his board; but showing him as a Mission Flight
Control Officer (MFCO) versus being the chief of MFCO training is  not
only incorrect, but hurt his chances for  a  fair  evaluation  of  his
records.  He is not sure if this has any effect on his request  for  a
SSB, but thought he should give this information to the  Board.   This
continues to be an uphill battle to get  his  records  corrected.   In
further support of his appeal, applicant has submitted  copies  of  AF
Form 2096, classification/On-The-Job Training Action, several AF  Form
709, Promotion Recommendation and copies of OPR for the period  ending
3 Feb 2003.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice.  After reviewing the complete case
file, the Board noted that the  applicant's  Officer  Selection  Brief
(OSB) reflected an incorrect  assignment  history.   While  we  cannot
state with certainty that the inaccurate  assignment  history  on  the
OSB's were the cause of the applicant’s nonselections  for  promotion,
we do believe it may have prevented him from receiving full  and  fair
consideration for promotion.  Therefore, to offset any possibility  of
an injustice, we recommend he be given consideration by SSB's with the
corrected OSB in his records.  We note  that  the  applicant  has  had
other corrections to his record and when he is notified to review  his
records prior to being considered by SSB, he should be  certain  these
changes are a matter of record.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that the Officer Selection
Brief (OSB) prepared for the Calendar Years 2002A and 2002B Central
Major Selection Boards be amended to reflect the deletion of “86P0,
Search and Rescue Controller, --- ---- Area Audit, PAC, Hickam, HI,
effective 1 June 2000 under the section of assignment history.

It is further directed that his record, to include the above corrected
OSB, be considered for promotion to the  grade  of  major  by  Special
Selection Boards for the Calendar Years 2002A and 2002B Central  Major
Selection Boards.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

               The pertinent military records of the Department of the
Air Force relating to APPLICANT, be corrected to show that the Officer
Selection Brief (OSB) prepared for the Calendar Years 2002A and 2002B
Central Major Selection Boards be amended to reflect the deletion of
“86P0, Search and Rescue Controller, ---- ---- Area Audit, PAC,
Hickam, HI, effective 1 June 2000 under the section of assignment
history.

             It is further directed that his record,  to  include  the
above corrected OSB, be considered for promotion to the grade of major
by Special Selection Boards for the Calendar  Years  2002A  and  2002B
Central Major Selection Boards.
