APPLICANT REQUESTS THAT:
His Meritorious Service Medal (MSM), third oak leaf cluster (3OLC), for his
tour ending 6 July 2001 be added to his preselection brief and that his
record receive Special Selection Board (SSB) consideration for promotion to
lieutenant colonel by the Central Selection Board that convened on 5
November 2001.

APPLICANT CONTENDS THAT:
Without his knowledge and through no fault of his own, the MSM was late
being written and processed. His inquiries in mid-October 2001 revealed
his award was still being processed. The award was hand-carried to insure
it would be in the record prior to the date the CY01 Lieutenant Colonel
Board convened; however, it still did not appear in his record. Knowing
that he was meeting a board, he considers this to be gross negligence on
the part of his supervisor and wing. He believes the omission on the
preselection brief had a negative impact on the board.
In support of his request applicant provides letters of support from his
rater, additional rater and a senior officer, a copy of his preselection
brief and a copy of his order awarding him the MSM 3OLC. The applicant’s
complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
Information extracted from the Personnel Data System (PDS) indicates the
applicant’s Total Active Federal Military Service Date is 12 September
1986. He is currently serving on active duty in the grade of major, with a
date of rank of 1 January 1997. By orders dated 24 October 2001, the
applicant was awarded the MSM (3OLC) for service during the period 2 July
1998 to 6 July 2001. His Officer Preselection Brief (OPB), dated 24
September 2001, reflected three MSMs. His Officer Selection Brief (OSB)
for the CY01B showed he had been awarded four MSMs, most recently, in 2001.
He was considered and not selected for promotion to the grade of
lieutenant colonel by the CY01B lieutenant colonel (chaplain) central
selection board, which convened on 5 November 2001. Applicant’s OPR
profile since promotion to the grade of major follows:

The rater and additional rater recommend applicant’s OPR for the period
ending 9 April 2000 be corrected to reflect a Senior Service School (SSS)
in residence recommendation. AFPC/DPPPAE advises that since applicant has
completed Intermediate Service School, recommendation to SSS is
appropriate.

AIR FORCE EVALUATION:
AFPC/DPPPOO recommends the application be denied. DPPPOO states that
although the applicant’s Officer Preselection Brief (OPB) did not reflect
award of the MSM (3OLC), the Officer Selection Brief (OSB) was updated to
reflect the award and a copy of the citation was filed in the Officer
Selection Record for the board to review. The DPPPOO evaluation is at
Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 20 December 2002, a copy of the Air Force evaluation was sent to the
applicant for review and comment. As of this date, this office has not
received a response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice with respect to the OPR closing 9 April
2000. Based on the testimonies from the rater and senior rater and their
apparent admission of an error with respect to the applicant’s Professional
Military Education endorsement, we find that relief is warranted in this
matter. We note that the applicant did not specifically request this
correction to his military records; however, we believe he may have been
disadvantaged as a result of this error when the CY01B Central Lieutenant
Colonel (Chaplain) selection board considered his record. Therefore, we
believe the 9 April 2000 OPR should be corrected as indicated below and his
corrected record should be considered by an SSB.
4. Although the applicant’s OPB did not reflect the award of the MSM
(3OLC), it appears that that the award was shown on his OSB and the
citation was filed in his Officer Selection Record (OSR) seen by the CY01B
selection board. In the absence of evidence by the applicant to the
contrary, action by this Board concerning the applicant’s stated request is
not required.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected by deleting the statements, “Send to AFIT, ACSC
in-residence and then to MAJCOM!” in Section VI, Rater’s Overall
Assessment, and the statement, and “Send to AFIT then ACSC in-residence!”
in Section VII, Additional Rater Overall Assessment, from the Field Grade
Officer Performance Report, AF Form 707A, rendered for the period 10 April
1999 through 9 April 2000; and, replacing the deleted entries with the
statement, “Send to SSS in residence.”
It is further recommended that he be considered for promotion to the grade
of lieutenant colonel by a Special Selection Board (SSB) for the CY01B
Lieutenant Colonel (Chaplain) Selection Board and for any subsequent board
for which the uncorrected Officer Performance Report, AF Form 707A, closing
9 April 2000 was a matter of record.

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to , be corrected by deleting the statements,
“Send to AFIT, ACSC in-residence and then to MAJCOM!” in Section VI,
Rater’s Overall Assessment, and the statement, “Send to AFIT then ACSC in-
residence!” in Section VII, Additional Rater Overall Assessment, from the
Field Grade Officer Performance Report, AF Form 707A, rendered for the
period 10 April 1999 through 9 April 2000; and, replacing the deleted

Based on these statements, we recommend that the duty title be corrected. In his appeal to this Board, applicant has requested that he be considered for ISS, which is the appropriate PME recommendation that should have been indicated on the OPR. Therefore, we recommend the duty title and PME recommendation be changed on the contested OPR and that his corrected report be considered for promotion and ISS by SSBs.
